The jury will never see these documents. It can’t be widely known that the security of America was never put in any danger but the president taking personal papers with him.

Add to that the president’s absolute authority to declassify and there isn’t a path to conviction but that was never the goal.

In arguments essentially of the government (Biden Admin) vs the government (Trump), you propose the prosecution be advantaged with a "take our word for it, these were essentially the nuclear codes," ruling. Taking that stance essentially establishes the government (Biden Admin) is to be assumed trustworthy, while the government (Trump) must prove (w/o capacity to produce the records in question) the records were (a) personal to the POTUS, (b) confidentially maintained, and therefore (c) no security risk as NARA particulars were worked through.

Almost all, if not all, of these are legal questions/issues and have nothing to do with this discussion.
