Because burning your garbage doesn't qualify as speech under the First Amendment.

If you were prosecuted under a local ordinance that prevents you from burning your trash, you could not successfully present as a defense that you were simply exercising your right to free speech.

The law has defined fighting words.
It is a long established doctrine in Constitutional Law.

To some, the burning of the flag would fall under that category.

EPA regulation violation perhaps? You know, a snowflake needs to stay focused. What you say? Well there is the matter of CO2 emissions from burning a flag you know.

"Fighting words" are words directed at a particular person amounting to a challenge to an immediate physical fight.

If you knocked on your neighbor's door and when he answered burned a flag with a sign that said "F*CK YOU DAVE" then the First Amendment would likely not protect your speech.

But just burning a flag in protest in the street within view of people who would take offense? Nah. It's still protected speech.

There was a time when this could in fact land you in jail in certain States. Then the Supremes stepped in. The left has completely divorced itself from actual history and so we end up with millions of people who think such laws are core violations of our civil society. Most of the framers were very much alive when the movement to ban flag desecration was at its height.

I doubt very seriously that the EPA has issued a regulation with a threshhold so low that it would encompass burning a flag.

IIRC Louisiana passed a bill 30 years ago or so that made it a $5 fine to assault someone burning a flag. I think it was cancelled shortly thereafter due to the courts. Anyone remember this?

My dad used to say there would be a line of red necks and Cajuns lined up waving $5 bills if someone was stupid to do it. If only......

Jesus I think we can agree on just burning people the wear flag cloths. Umm No I really don't get my panties in a wad. I don't honestly care what people do. Nothing anyone does or says can ever diminish what the symbol of the American flag means to me.

I do however honestly believe that the people doing these things to the flag are not doing it to make any statement whatsoever other than to do something that they know drives the people they hate wild and gets under their skin. Really do you honestly think that burning a flag will ever in a million billion years make someone who sees the flag as a symbol of pride stop and say "Oh, you're upset about something, come in and lets talk about it." No, and they know this. They don't even want to talk about the problems, they want to make the other people feel as frustrated and angry as they feel like they do. It's not about fixing anything, its about lashing out.

That's why I say if people are offended by people burning the flag, then they should seek out the symbol that best represents the people burning their flag and burn that symbols too. Be it and African flag, gay pride flag, LSU flag whatever.

No none of this settles anything but apparently it make you feel better..

These people truly do not grasp what the real greatness of this country is all about. Freedom of thought and speech is the foundation of our country.

Didn't we just win an election to oppose those who stifle "incorrect speech", at least that is what I though.
