What real options does Congress have?
You are talking about LEGAL options, Wick, to fight against a criminal opponent who will IGNORE both the spirit and the letter of those actions. They'll gum this stuff up forever.
It is going to take the fire with fire version to offer equal force, and stop them in their tracks. Rick Perry down in Texas may well be the start. Holder WILL challenge him, and if Perry orders and DOJ Marshalls that show up in his office, to be arrested...then that will get the ball rolling.
Just now, hearing that Congress is subpoenaing the ITs in the IRS to see who did what to the hard drives. They are chasin their tales. It'll be a shell game for years.
It'll take (unlawful) fire with fire to fight this. Obama wanted - and is engineering - a "fundamental change". He's fixing to get it. We all are.

The emails are older than 6 months
Ummm...according to the IRS procedures manual they are using Microsoft Exchange to store emails on exchange servers and then according to Part 10, Chapter 8, Section 60, Subsection 10.8.60.4.4 in their procedures manual all emails are backed up and stored off-site.
So yes. Unless someone bombed multiple huge federal data storage facilities, the emails still exist.

quote:the IRS "cleans" their servers every 6 months, but they don't record the data before cleaning. They ask citizens to keep 7 years of data for audits but they only keep data for 6 months.
Why don't they check the server?

That's incorrect. It's a talking point aimed at the technologically ignorant masses. I just referenced the official policy.

I would find it very hard to believe the IRS doesn't do the same thing.

It's very telling that libs think (pretend) that it is appropriate that the only archive location of old emails to be on the client workstation.
It's laughable.

Someone needs to do some jail time over this.
It's very apparent now that the White House is involved.

Because someone's computer crashed years ago and they followed normal IT protocal in recycling the computer because they couldn't retrieve the data upon several attempts.
What criminal law do you suggest has been violated?
Show me the work logs and the documentation that all of that happened before she was called to testify before Congress and then I may back off a bit.
As it stands now, this thing stinks to high heaven.

Lerner should be charged with obstruction of justice. What a corrupt administration we have.

This happened in July 2011, roughly two years before any of this crap. You can read the chain email at the bottom of the article I linked to earlier in this thread.
And you will notice that it was Lerner who was requesting that they keep trying to recover the data.

So how bad were the emails for them to pull this stunt...
Bad, like alot of Dem Congressmen, and all the Administartion would be in jail-type bad IMO.

Every federal agency is required to have a Continuity of Operations Plan. The plan requires that they make and store duplicates of everything. These duplicates are maintained in another safe location in the event records are destroyed by fire or natural disaster or nuclear attack.

It's shocking to me that you will even give them the benefit of the doubt here. One of two things has happened.
1) The IRS used their power to target political opposition and are now perjuring themselves and obstructing justice to cover it up, or
2) The agency responsible for taking our income, the same one that can go back decades and find instances where your parents missed payments and then asses them to you, cannot be trusted to maintain records of fricking emails. The entire thing should be dissolved.

MSNBC Ridicules IRS over lost emails this morning.
Even MSNBC is sick of this shite.
I had dinner last night in Vegas with our VP of Sales. He is extremely liberal, and an Obama apologist. Our CIO was there, too. Also liberal. I said to the CIO, "If I were to do something using my email that was potentially criminal, but wiped it from my computer, even destroying the hard drive, would I be safe from discovery?"
The CIO said no. He said every email ever that goes through their system is stored and archived on two large servers with RAID arrays. So I said, "well what if John, the owner of the company directed you to erase those messages?" He said, he could do that, but then he and John would both be guilty of conspiracy and interfering in an investigation.
So later, conversation moved on to a discussion of Bergdahl. There was back and forth and I just listened in, then finally said, "Why are you arguing over Bergdahl when the very foundation of our government is being usurped and laws are being broken, blatantly broken, by this administration. Emails are missing? Emails that could potentially damage the president beyond repair have been deleted and the media is just simply being lied to."
Crickets chirping. Not one word from either of them. They both know that the White House is lying through their teeth, but refuse to acknowlege that their king has no clothes.
