Government gathering data offshore; avoids courts

Buried in headline story from Drudge:

quote:

Some U.S. telecommunications companies willingly provide intelligence agencies with access to facilities and data offshore that would require a judge’s order if it were done in the U.S., one of the four people said.
In these cases, no oversight is necessary under the Foreign Intelligence Surveillance Act, and companies are providing the information voluntarily.

The extensive cooperation between commercial companies and intelligence agencies is legal and reaches deeply into many aspects of everyday life, though little of it is scrutinized by more than a small number of lawyers, company leaders and spies. Company executives are motivated by a desire to help the national defense as well as to help their own companies, said the people, who are familiar with the agreements.

When it comes to your money, if it goes offshore, the government will grill your ass. But when it comes to your personal information, government is more than willing to go offshore and circumvent civil rights.

W.T.F.

ETA: Replaced "to avoid" with "avoids" to state fact rather than an opinion of intent. Hope this is satisfactory.

Because according to FedGov, it's not your money, it's theirs.

I think you're misreading the statement. Govt doesn't gather data offshore, the data is already offshore....govt doesn't go after it to avoid courts. Companies provide their data voluntarily.

Don't you find that just a tad disingenuous?

The op title is.

Thank God you guys aren't lawyers. Your ability to distinguish atrocious.

Eta: let me give you an analogy... Every day the govt ask folks to do things people have every right to say no to.... May we search your car? Can we have a look inside? They don't have some subversive intent to avoid courts. They ask. You comply (and you shoudnt). Same here.

If I can't state their intent, neither can you.

Understandable. However, when the same government has the ability to tax, audit, make life hell for said company...or look the other way if said company provides this information, it is not an apples to apples comparison.

That said, shame on the companies for freely giving such information.

In any event, it just seems wrong on several levels for the government to be acquiring, maintaining and/or using this information...even if they have the "right or ability" to acquire it. This should be especially true of an administration that specifically ran a campaign against this type of activity.

The government is finding ways to work around the law or if we want to be honest finding ways to break it. The rule of law is such a pesky thing.

Government follos the letter of the law. They just violate the spitit of the law whenever it suits their purpose. And this is a classic example. It is why politicians can not be trusted. They are the ones who tolerate this crap by not punishing offenders.

Anybody know how reliable Cnet is?

I just came across this:

NSA admits to listening to phone calls without warrants

quote:

The National Security Agency has acknowledged in a new classified briefing that it does not need court authorization to listen to domestic phone calls.

Rep. Jerrold Nadler, a New York Democrat, disclosed this week that during a secret briefing to members of Congress, he was told that the contents of a phone call could be accessed "simply based on an analyst deciding that."

If the NSA wants "to listen to the phone," an analyst's decision is sufficient, without any other legal authorization required, Nadler said he learned. "I was rather startled," said Nadler, an attorney and congressman who serves on the House Judiciary committee.

Obama pulling a GITMO!

I fricking love it. He's not only not Bush, he's Bush on fricking steroids!

But, of course, he has no knowledge of this. His people can do anyfrickingthing that they want to after he tells them to do it. And when the administration is questioned, they either had no idea of what was going on or can't remember.

Our president is not clueless.

He is a buffoon.

ETA: forgot bumbling fricking idiot...sorry.

I'm sorry but that is just one giant load of horse shite.

If the govt is telling people, "hey, we have these intelligence capabilities but we pretty please promise not to do X,Y and Z and see, we have this cool FISA court to help ensure you are protected" then when that same government even ASKS for a fricking path that it KNOWS avoids doing exactly what it PROMISED, that is fricking crooked.

Good God. You act like when they ask to see that shite offshore they don't understand what it is they're doing. The same a-holes who are doing this are the ones standing in front of the American people saying the WON'T DO IT!!

By the looks of the cnet article, seems they might've been lying about their domestic activities always having warrants.
