Race, as defined by free dictionary:
1. A group of people identified as distinct from other groups because of supposed physical or genetic traits shared by the group. Easy way to solve this problem. We just go by the races that anthropologist use. Which is caucasoid, negroid, and mongoloid. If biracial use some damn common sense and put what two you are.

In the context of the questionnaire, which specifically stated Hispanics are not a race when instructing the questioned how to answer questions 5 and 6, the questioned is not allowed to answer Hispanic as a race:

One thing that you'll notice from that and the census in general is that they subdivide lots of different races but never black. If you are Pacific Islander you get a dozen subchoices. The same with Asian and even Hispanic (not a race). But black is just black.

Whites divided Americans by race for generations, but when that information is used for equality instead of discrimination then it becomes a problem.

Hispanic/Latino is an ethnic group, not a race. I have a friend who married a swarthy Mexican. Their kid is blond hair and blue eyed. Is he white? Hispanic? White Hispanic? I'm sure he could legally check "Hispanic/Latino" on a college app and get AA preferences.

I'm sure they could, as long as they have some documentation. You wouldn't want them to pull an Elizabeth Warren. Though that whole things to have worked out for her.
