Federal Judge says city is racist, then lets it secede from school with blacks

This is kind of a head scratcher.

I don't recall ever seeing a Federal Judge accuse folks of being racists and then ruling in their favor.

Judge: Mostly White city may secede from school district

She also found that Gardendale failed to meet its legal burden to prove that its separation would not hinder desegregation in Jefferson County, which has been struggling to integrate its schools since black parents first sued for an equal education for their children in the 1960s.

Still, Haikala ruled Monday that Gardendale may move forward with the secession, basing her decision in part on sympathy for some parents who want local control over schools and in part on concern for black students caught in the middle. The judge wrote that she feared they would bear the blame if she blocked the city’s bid.

I don't know anything about what Gardendale is going through, but, based solely on what I know about the Hoover City School System's struggle to try to please this lady, I would have to say she is a moron.

ETA: We had a rezoning measure that doesn't really fix anything and only addresses race in place over 2 years ago, with neither side (the school system or the NAACP) opposing it, and she still hasn't approved it. Ridiculous. I would definitely not take her word as gospel on someone being racist.

I really don't think it's racist to not want your kids in the school district dominated by blacks. Even smart black parents don't want that

It's sad that this is considered a "surprising" decision. It looks like the town is well within its right per Alabama law.

Dont you know?? The only state and local laws that trump federal laws are laws on migration such as sanctuary cities etc.

This whole thing is a mess from the very beginning... (I actually live in the area)

So - Gardendale City allowed Jefferson County to build a $50mil facility in their city - the Gardendale (Bragg) Middle School and Gardendale High School actually service a lot of people from the surrounding areas. The high school is also the Tech School for the entire county... you know, learning about those "dirty" jobs that this board constantly talks about people going into, instead of college. So every student in the country will come to "Gardendale High School" for tech school teaching.

Right after the facility is built to facilitate all of this - Gardendale decided "Ok, we want to take this High School and (also the middle school) create our own system. Jefferson Country originally was like "hey guys, could you at least give us some of our 50mil back (they asked for 30mil originally) so we can build a new High School for the people you are displacing? Gardendale basically responded with a "frick you, it's ours, bbye"

The reason this order is kinda all over the place - is Gardendale can't afford the $35mil - $55mil that they will have to now pay Jefferson County to build a new middle and high school for the displaced children - including a new tech school.

The whole thing is a mess, Jefferson County BOE is a mess - but no other "individually owned" Board of Education had been formed where the newly created BOE allowed Jefferson County to build them a school and then took it and walked out... in the same area Trussville had a chance to get a new High School from Jefferson County, and was up front with them and said "nah, we are starting our own system... so we will just build our own."

One other thing - Gardendale is full of shite, they could barely pay their payroll 12 months ago for their city employees - yet they wanted to start their own goddamn school system. They live in lala land, they are not even close to the size of any other areas that have their own school system... and they did this to themselves - all because they dislike their neighbors to the south so much, they wanted to keep them at arms length. (I kid you not... most of this started because of a tiff with the neighboring city to the south)

Those things may all be true, and those are excellent reasons for them not to be allowed to have their own new school system, but this judge is saying they made this decision based on race. How do any of those things make this a racist decision?

This is true. They got Jefferson county to build them a new highschool and then decided to form their own school system.

Then ... Democrat policies disintegrated the black family unit and black abortions skyrocketed.


"Equal education" is just like this equal healthcare under Obamacare ... it means "EQUALLY SHITTY."

St George is currently unincorporated with no city government. Slightly different. Sounds like this was a separation of a school district into an ISD within an existing town? Maybe a local poster can clear that up.

Part of that money came from Gardendale residents or people that purchased goods in Gardendale. If Gardendale can afford to do it then I say they should have that right but I just see Jeffco BOE doesn't want to lose that tax revenue that is generated in Gardendale or the rest of the county.

They have squandered away millions of dollars in the construction of all these new schools. Someone in the BOE is getting their pockets filled with tax payer money.

The real problem is that this was an appealed decision from a lower court that came to Haikala. It's all kinda super convoluted... but the lower court basically told Gardendale, "yeah, you are free to take the $50mil facility and just do whatever you want, we don't even care about what that might mean for any of the kids or Jefferson County" - so when you appeal a decision, you have to run that decision off of the idea that "parts of this decision are totally legal, but there is no way 'x' should be allowed!"

The Jefferson County BOE went with the "they are being racist" argument when it went to the higher court... which in turn brought about this ruling. In saying this was racially motivated, she can now turn back the "amount owed to the Jefferson County BOE" decision by the lower court - putting Jefferson County BOE and Gardendale's BOE back at square one.

The big thing... is locally they handled this horribly, with posters across the city with a white child on a poster with the caption "which way will you decide for our children" or campaigns pointing to the eastern side of the county (predominantly black areas) and saying "don't let us end up like Center Point" . They didn't promote this well, and honestly as a resident, came off as EXTREMELY racist... too the point that my racist Grandmom actually voted against it, it was pretty funny, sad.
