This is the execution of a warrant against a suspect himself, not his counsel. ANY warrant MIGHT lead to seizure of privileged materials. Execute a warrant for the file cabinet of a gun runner. There MIGHT be a folder in that cabinet containing letters from his lawyer … or priest … or physician.


I'm also talking about this case... and cases similar to the Alex Jones case (but not that case) where the state "happens upon" privileged communications. There MUST exist a duty for them to IMMEDIATELY stop review of those communication for protections to still exist. There are inmates clients in my county who've had our communication writings opened but not read by jailers and the judges had conniption fits without an motions even being filed. The state listens to inmate phone calls being made to everyone but attorneys (They say), but I have seriously considered testing this and requiring arduous proof be provided that the state has zero access to these calls.

No... It's my position that the Government not review privileged material. The onus is on them to ensure that they do not. They are required to build the hedges and ensure the safeguards are in place. If they fail to do so, they poison the well.

No... It comes down to whether defendants, accused citizens, or suspects, have Constitutional privileges. They absolutely do. Just because the investigating agency is a 3 letter monster and not the Knox County Sheriff, that doesn't change.

That certainly includes you... You have ignored all Constitutional safeguards for the accused. I'd LOVE to see this kind of abuse reach SCOTUS with a high profile Defendant like Trump so that agencies know that can't pull this crap on my clients who make $55K a year.

Thank you. Not a big fan of it, should have a neutral party with the defendants attorneys and prosecuting or investigating agency present

I wonder if the team lead , Tim Thibault, who was fired today had anything to do with the taint review, or selecting those who did. If so, oh boy!

Come on, man. They're totally fair and honest, and their political bias played no part at all in their thought process about what should and shouldn't be privileged. And if they found something that was supposed to be privileged but incriminating, or something they thought could turn into something incriminating, they absolutely would NEVER tell the investigating team who they happen to work with. Because if there's one thing the FBI and DOJ is known for in 2022, it's honesty and integrity.

I don't know how damned stupid you would have to be to believe that. I suspect most people are intelligent enough to recognize that it's laughable bullshite, but some of them are dishonest enough to never, ever admit it.
