I would say both parties are in a dead heat race for being the dumbest. It's neck and neck. I honestly can see a third party becoming viable in the next 10-20 years. We need a third party badly to help keep the other two in check!

Sorta. Not technically disbarred but his Arkansas license was suspended and he resigned from the Supreme Court bar rather than contest the disbarrment.

Thanks, man! I didn't remember it exactly...but something in the back of my mind kept nagging at me. He doesn't need it anyway. It's not like he is going to practice law anymore anyway. he makes way too much money making speeches.

This is not a smart move by the Dems and I think they will end up caving. Or enough of them will cross the aisle to get to 60.

They should not force the nuclear option on Gorsuch replacing Scalia when you have over 3 more years of a very likely Republican WH and Senate. Trump likely replaces Thomas and Kennedy this term and potentially RBG or Breyer if something unexpected happens.

It is STUPID to leave yourself open to getting nuked with all of that on deck. If Trump replaces RBG and/or Kennedy with one from his list the court is dynamically changed against the liberals for years.

I know the Garland thing stings because the Dems saw an unexpected opening that would have been HUGE for them with Scalia's death. But the Republicans held the Senate and it is what it is. Confirm Gorsuch and grow up.

Trump is saving Cruz to replace Thomas. That way he can assure the court will move only slightly to the left.

Maddin was the freezing truck driver. The brakes in his truck froze and he called to have a repair truck sent out. He fell asleep while waiting and because of the sub-zero temperate and the broken heater in the truck, he started to suffer from hydrothemia. When the repair truck still didnt show, he unhooked his trailer, and drove off. He was fired because he abandoned the trailer.

Gorsuch dissented from the majority opinion when Maddin sued because he was fired.

I am assuming you meant the brakes on his trailer froze, and not on the truck. Otherwise he wouldn't be able to unhook and drive off. Was he an owner-operator or was he a company driver? Standard procedure for an unauthorized drop is firing, and that is usually dictated by the cargo insurance. I would think this would be an extreme situation though.

Do you have a link to the story?

ETA: I found the story. I personally wouldn't fire a guy over those circumstances, but that's me. I have also worked in transportation for nearly 20 years and have never been sued.

Thanks for that info. That gives some insight into why they might have wanted to fire him.

It still seems pretty harsh that after they fired him and he sued that something didn't get worked out and the company hire him back. But who knows. Maybe he was a bad driver and they wanted him gone.

It was a bad stance for Gorsuch to take IMO, but certainly not something that would keep him from being confirmed.

He said he read the law strictly, but he could have easily gone with the majority by agreeing with their definition of "operating" the truck.

He might want a do-over on that one.

Bottom line is Gorsuch is a very qualified judge who will keep the court of the overall persuasion it was before Scallia died. But if I were the Dems I'd be trying to get some kind consideration over the Garland thing.

I never have figured out why it is such a bad thing to have a 5-4 court that sometimes can move one way or the other depending on the law and facts.

If Republicans are willing to go nuclear over Gorsuch, they're damn sure willing to go nuclear to replace RBG or Breyer with another Scalia. In that case, the filibuster is worthless anyway, so why keep up the pretense?

Better to show the country that Republicans are willing to violate norms to get their far-right guy in now rather than wait until later.

Not trying, he is. Any honest assessment of his judicial history puts him at least as far right as Scalia, if not farther.

His record is outstanding, He doesn't fit the Democratic mold because his answers were not about legislating from the bench, which many Democratic appointed judges do all day every day. They are basically replacing Scalia with another Scalia. If that upsets you, I can't wait to see when they replace RGB with someone just like Gorsuch or someone even more "right" leaning.
