With a 2/3rds vote and support from SCOTUS, congress can do whatever the frick they want to.

We didn't declare war on them, so I don't think this is correct. The US hasn't declared war since 1942.

You're not making any sense. The question is stopping the President from initiating military actions. He has that constitutional authority.

Even if I accepted the fact that Trump was incapable of handling this situation while he has the greatest military mind of our generation sitting right next to him, I'd still rather him be in charge than the idiots in Congress.

That war was never authorized by Congress. We entered per U.N. resolution. Old-right conservatives like Robert Taft and Howard Buffett opposed the war on the grounds that it was an undeclared and unconstitutional war.

People on here who claim to be conservatives and constitutionalists should absolutely be appalled by Executive-waged wars. The Constitution clearly gives Congress the right to declare war, and Congress should not abandon or cede said powers to the Executive. Our founders saw what happened to Europe when kings had unilateral war powers. The neoconservatives and Democratic hawks have successfully normalized the Unitary Executive theory into reality.

The War Powers Act was a legislative act of Congress. They can overturn it.

The Constitution states that the President is head of the armies but that Congress has the sole power to declare war. Pretty sure it doesn't give the President authority to start anything. If it did Congress wouldn't have needed to pass the War Powers Act.

Well, the Constitutionality of it has never been challenged, but neither has it been explicitly acknowledged by any chief executive (of either party) since passage.

And do you think they have enough votes to override a Presidential veto?

Because that's what it would take.

If I remember Con Law correctly most legal scholars think the Constitution gives the President unilateral authority to react to an invasion and defend the country, but anything beyond that would require Congressional approval. But the nature of warfare is so different now it would be interesting to hear a SC opinion on it.

But this will never pass. I doubt they even have the votes for a simple majority. A Republican voting in favor would be an enormous slap in the face to Trump.

The legal scholars I mentioned were discussing the powers given to the President in the Constitution, not through the War Powers Act

You are downvoted for wanting to obey the Constitution when it comes to warfare. Undeclared wars are cheered by folks like McCain and Graham for a reason: it is much easier for us to go to war when the decision rests in one person's hand. This board conveniently forgets that. If we go to war, Trump needs to channel Rand Paul, follow the damn Constitution and have Congress declare it.
