What are the written rules regarding this? Are the passengers the only allowed to drink?

Anybody can drink in a boat, even the driver. Just can't be over .08 BAC.

DWIs are common on the pleasure boAt areas with lots of traffic. I see it all the time on the Diversion Canal.

I only drink on afternoon fishing trips because if I start too early I need a nap.
Tha law prohibits being legally drunk (over.08).

The actual rules are that as long as you're not in a powerboat acting retarded you aren't going to be the first person they go after.

Second level is you're in a powerboat so they're going to stop you at random anyway so don't be so fricked up they can tell it.

Third level is anybody on a jet ski is a scumbag that deserves all the problems they can reap.

Get a sailboat get hammered game & fish never ever gonna stop you. Plus chance of killing someone with a sail boat is lower.

A DUI while driving your boat is the same as auto and goes on your record.

People are arrested every week in the summer, hand cuffed and hauled away

Honestly, I have seen far too many people arrested...I decided a long time ago that if I am driving, I will stay away from the alcohol....just not worth the misery that it can cause...

Drinking and driving a boat is the same as for a car. On a boat you are better off snorting coke off the bare belly of a tuna.

I have never heard of anyone fishing from a bay boat in south LA that got a dwi without doing something stupid.

Get on the Ouachita in the summer with beer on your breath or one too few life jackets and you'll likely sleep with the fishes...

What Cracker said. But we probably shouldn't say it too often.

Average possum cop has no clue how to 'pull over' a sailboat. And generally sailors know more about boating than anybody on the water so the odds of catching them at something are slim. They have to be prepared for everything because they can't just gun it and run for the dock. Too many easier targets out there with motors on them to bother with sailboats.
