Everyone's missing the play here. The only way that Chavis could file suit (and select the venue (Brazos County)) is if A&M took the position that it didn't owe him anything. Therefore, he files for a declaratory action in Aggieland beating LSU to the punch in being able to file lawsuit for damages in EBR Parish. Of course, A&M will pay the judgment if a court in Aggieland says Chavis is on the hook, but what do you think those odds are? Alleva outflanked once again.....

This seems to be the case...

Didn't he get on the plane and go back to Knoxville after the game; which has done numerous times before?

Screw him. He had a written contract and should be held to the letter of it. If he and the Aggies want to fight it out in court, let them have at it.

On the freaking A&M facebook page they still have Chavis visiting recruits, with Sumlin, in a damn A&M pullover on JANUARY 15TH! How the hell can he be stupid enough to consider himself an LSU employee at that point? You absolutely fight this in court. He broke his contract and it was completely his decision.

not so fast my friend. He may win the legal battle but lose the p.r. war.

Chavis filing suit against his employer is not going to sit well with his fan base. on top of that, if his defense, with little talent, get's rolled a few times this season. How you think he will be perceived in those parts. he could be coaching for his job the very next year and lose it if they don't perform. In the end, he loses more than 400k and his rep.

all in all. it truly shows chavis lack of character. he has handled this as poorly as anyone could possibly handle it.

Frick that. Chief sued LSU. LSU needs to tack on attorney's fees and costs to the $400k now (which I'm assuming are available in this dec action-type situation). I'm sure aTm will love having to fork over even more than the original $400k. Nice work chief.

ETA: I'm sure there is an attorney fee provision in the contract. Chief

I'd like to know how he can recruit for A&M without working there.

ETA: Especially since he never actually recruited for LSU while he was really working here.

Given the fact that we announced the hire of Ed Orgeron the day after the recruiting dead period, I'd rather not open that can of worms.

If you were ever so lucky to be as in demand as Chavis and in your new contract with your new employer it says that your new employer will indemnify you in the event that your previous employer sues you for liquidated damages, you would absolutely sue your new employer and your old employer in a declaratory judgment action to have a judge tell either your old employer it is not entitled to the liquidated damages or to tell your new employer that it is required to pay those liquidated damages.

This is a non-issue made into an issue by people with no understanding of the law or, apparently, employment.
