So the "fact" that he was trying to cheat the trust was untrue and just hyped up junk by Rita's side.
Also, even if he is deemed incompetent they still don't get the voting shares of either team, meaning they'll never have say in how the team is run. They just get to profit off of them.

Attorney Paul Cordes said the various trusts contain 95 percent of the shares of Benson Basketball, the holding company for the Pelicans of the NBA. The remaining shares are held by Tom Benson, who controls all of the voting shares in both companies.

He did a lot to delegitimize the other sides argument imo. And if they argue too much, it will expose them for what they are.

"Voting shares in the team" - could Gayle and co. spend insane amounts of money to make them competitive (particularly the Pels because there's no hard cap) as a big F U to Rita? That would be even sweeter than paying her to go away.

I'm pretty sure that, unless things go haywire, Gayle will rely on Lauscha, Loomis et. al. I don't think she'll go way over the NBA cap just as a FU. Although, I kind of like the idea to be honest.
