It would depend on if the Saints/Pelicans were community property with Gale -- which I have no idea if that's the case. If he died intestate in that case, his children would get his share of community property and Gale would get usufruct over the entirety of the community estate.

Doesn't bode well for the saints or Pelicans when he dies. From all accounts Gayle seems like a good woman though.
I will say situations like this happen A LOT, albeit usually with many less assets.

On a side note, the estate tax needs to go away or be reduced considerably. There is no logical reason that the Benson family should have to pay taxes of 50% or whatever the number is because he passes away.
