Unless the victim's life was in danger, he's fukt.
Theft of an iPhone is not considered life threatening, although some housewives may disagree.

Overkill for an iPhone I think.

You think wrong. Not overkill for stealing anything. If you want to steal, you take the chance of getting shot, end of story and no punishment should ever be levied against the victim.

Without a doubt. I like the fact that a thief got plugged but it's not a justifiable shooting.

Life > Cell phone

EDIT: Unless victim's life was threatened in the process. Did not open link.

When committed for the purpose of preventing a violent or forcible felony involving danger to life or of great bodily harm by one who reasonably believes that such an offense is about to be committed and that such action is necessary for its prevention. The circumstances must be sufficient to excite the fear of a reasonable person that there would be serious danger to his own life or person if he attempted to prevent the felony without the killing.

Forcible felony includes robbery.

I'd say having a gun pointed at you means you're life is in danger. In LA, you are able to defend your self by any means necessary if your life is threatened, i.e. having a gun pointed at your face.

The victim needs to say the thief stated that he had a gun and the guy better give him his phone or he was going to shoot him. And don't deviate from that story.

George Zimmerman knew this.

Would include being scared for life in there. I know it's assumed but saying it is money.

Do "journalists" even try anymore? That article is horrible. How about getting some facts before running the story?

"Something happened. Not sure what. Police aren't spoon feeding us details. We don't feel like trying to ask anyone else. If someone drops the story in our lap we may write something else."

I do not understand the "It's just an iPhone" shite. At what point is shooting someone who is committing a crime? Do you have to mentally make sure its worth 10k or more before its OK to shoot someone robbing you? GTFO.

I'm assuming you meant that for someone else... I'm all for shooting robbers.

So you can

I'm still not seeing anywhere in the news article where the thief had a gun.
It looks like it was a snatch and run move.
