all other racial and ethnic groups are insulated from competing against high-achieving Asian Americans,” the filing said.

Seems to me that Asians have a solid "disparate impact" argument. Isn't that the bull shite blacks use when they end up on the short end?

Uh oh, are people gonna have to start acknowledging that the term "minority" doesn't just mean blacks and Hispanics?

The claim within the article points to a static statistical relationship of diversity over a long period of time while Asians have had an increased application rate. The question isn't whether or not they have quotas but whether it's legal to discriminate against other minorities in order to achieve perceived equality.

There really have been several instances where the fact black race mongers only really mean "blacks" when they say minorities. They only recently started including Hispanics because their population had increased.

The funny part us the Asians should basically say, "hey, so the black argument is it's ok if whites are racists towards Asians"

Umm kind of like on this board when a thread pops up along the lines of "Why do minorities vote D" and the first 15 responses are some iteration of "bc the want their govt handout/they're on the dole/they need their obama phones." I mean, Asians are minorities too right?

Isn't there also a white female suing Texas universities for the same reason?

ETA: Yep. She lost.

quote:

three-judge panel of a federal appeals court upheld the University of Texas at Austin's use of affirmative action in college admissions Tuesday.

"It is settled that instruments of state may pursue facially neutral policies calculated to promote equality of opportunity among students to whom the public schools of Texas assign quite different starting places in the annual race for seats in its flagship university," Judge Patrick Higginbotham of the U.S. Court of Appeals for the 5th Circuit wrote. "It is equally settled that universities may use race as part of a holistic admissions program where it cannot otherwise achieve diversity."

quote:

he Supreme Court in April ruled states can ban affirmative action in college admission policies without violating the Constitution. The ruling did not widely outlaw affirmative action policies, but allows the eight states that do ban those practices to continue doing so.

It's finally come full circle. People aren't truly equal if we continue this "more" equal than others crap

Technically, but not really...at least so far.

She lost at the Fifth Circuit and went to the Supreme Court. She won at the Supreme Court, who sent it back to the Fifth Circuit. She lost again at the Fifth Circuit, with some very, very strong dissents. She'll be back at the Supreme Court again, and there's a good chance they'll take the case a second time.

diversity is a good thing.

And if a school wants to bring in kids from different backgrounds and they take that into an holistic approach, I have no problem with it.

Everyone that goes to these schools are high achieving.

People act like Harvard is letting in gutter kids with 23s on the ACT

Eh, but when you turn down 40 Asians with perfect SAT scores and GPAs for a different minority with 3/4 of those chops, you have a problem.
