Former UT player filing $50B lawsuit against NCAA (head injury related)

According to KEYE, "Whittier's class action lawsuit includes all former NCAA football players who played from 1960-2014 who did not go on to play professional football and who have been diagnosed with a latent brain injury or disease. The lawsuit claims the NCAA has breached its duty to protect college football players 'in the face of long-standing and overwhelming evidence regarding the need to do so.'"

since he is diagnosed with Alzheimer's, i do not believe he can legally file a lawsuit since he does not have the legal mental capacity to do so.
the person that is listed as power of attorney would have to be the one doing to suit in his name.

you can absolutely file suit...you cannot enter contracts without capacity

I have no problem with the old schoolers getting paid, they were told by Doctors that they were ok, even though they weren't. They lied to the players about their health, to benefit the teams.
they deserve to dry frick the ncaa and nfl
but the guys in 90's to today? No dice, you knew the risks and the warnings.

This was my initial thought as well. I remember from one of my undergrad law classes when we talked about contracts that people with mental illnesses can't enter contracts because they don't have the mental capacity to do so.
I'm not a lawyer though so I don't know exactly how this stuff works, but wouldn't a contract with an attorney have to be reached for him to file this suit?

This is just more fleecing of NFL/NCAA by POS plaintiff's attorneys and deadbeat former players (many of whom got great opportunities in life ONLY because they were football players). When HS, college, and pro football no longer exists or doesn't resemble the game we know now, people will only have ridiculous litigation to blame.
It started with the NFL, has now moved to college, and will eventually hit the HS ranks. Once that happens, many HS and small colleges will start to make the business decision that it is cheaper to just do away with football rather than absorb the potential risks of fielding a team.

If Roger Goodell ran the NCAA, Les Miles would be suspended for the 2015 season and then everything would be okay.

If they win, how long do you expect football to continue as a sport.
The lawyers will get the billions the players will get $50.
