Child Custody Advice

I have 50/50 custody of my daughter, My Ex-wife is the domicilary parent. She informed me this morning she is moving, changing my daughters school and day care clear across town, but still in the same parish. Turns out she is movin back home with her parents. Now i was informed that if that were the case I could take her back to court and get full custody of my daughter because her having to live with her parents is looked at as her not having a place to live or support herself...Does this sound legit?!?!

I hope so. It's seems dumb for the judge to look at her living with her parents as a better situation than you having your own place, but usually the man gets screwed in a divorce.

It doesn't to me. As long as the child is being taken care of, I'm pretty sure that's all the court is looking for.

you know when we split up I was working nights and she worked during the day and she told me if i would have "taken care of things at home" she wouldnt have ran off with the UPS guy....i guess you are sort of right

Full custody, no. But you have a chance of being named domicillary parent.

In every jurisdiction I've ever seen, the best interest of the child will prevail. There are very few bright line rules when it comes to custody. The move may open the door for you to seek a modification, but all of the factors related to the child's best interests will likely be weighed by the judge.

How'd that work out for her? Sounds like he moved on.

I didnt give her anything. She filed for divorce while i was out of town working, so I never was served my hearing papers and when you dont show up to the court hearing they just give her what she wants. She was nice enough to give me 50/50 but she still hit me with $700 a month

the car she drives is in the UPS guys name and he pays for it. So when shes leaves she will not have a car
