Sgt. Bowe Bergdahl has retained a high-profile attorney — the same lawyer who defended Capt. James Yee, a Muslim Army chaplain cleared in an espionage probe a decade ago.

Bergdahl’s lawyer is Eugene Fidell, a Yale Law School scholar, prominent military legal expert and a co-founder and former president of the National Institute of Military Justice.

The Army is investigating the circumstances that led to Bergdahl’s disappearance and capture, probing allegations that Bergdahl walked off his remote post in Afghanistan without authorization before militants seized him. After five years in captivity, Bergdahl was freed May 31 as part of a controversial exchange with the Taliban for five militants who were in detention at Guantanamo Bay, Cuba.

In an interview with Army Times, Fidell said Wednesday he was “gratified” at having been approached to represent Bergdahl and that he has since met with Bergdahl last week at Fort Sam Houston, Texas. Bergdahl has concluded an Army-led reintegration process and this week was assigned a desk job at the headquarters for U.S. Army North.

“This is a soldier who has been through an indescribable ordeal, and we can never lose sight of that,” Fidell said.

Fidell said Bergdahl was, “grateful to the president for having saved his life.” Otherwise, Fidell did not offer his own conclusions about Bergdahl’s condition or state of mind. Nor would Fidell comment on whether he or Bergdahl were in communication with Bergdahl’s family.

So basically he was able to communicate the points he wanted without putting forth any new information. Brilliant!

I am embarrassed to admit, I did not think about that when I posted it. Possibly pro bono or someone with some deep pockets. I think it goes without saying he has some benefactors right now.

He has his work cut out for him. I firmly believe you are innocent until proven guilty. But there is a tremendous amount of evidence that he deserted.

He'll get his publicity regardless of the outcome.

I hear ya brother. I am hoping that we have a (relatively) smooth AR 15-6 investigation regarding him. If the findings are that he committed a crime, then I want a well run trial. He does not need to be made a martyr in the criminal process. Let the system work.

Berghdahl should be acutely aware of his predicament: he is a citizen of a country that loves their guns. Think about that for a second. If you live in a country that loves cupcakes, imagine how they would feel about an institution that specializes in cakes, cupcakes, all the deserts you can imagine.

This country loves it's guns; thus this country glorifies the military. Berghdahl seems to have spurned the war, and it's effort, at the least. Death threats and probably actual attempts will be a way of life for him from now on.

Mistakes were made, but none bigger than joining the military in the first place

AR 15-6 investigation

What does this mean, if you don't mind me asking?

Is the military court process much different than civilian (or whatever you call it) court process? I'm really interested in understanding this, if someone is willing to explain.

Eta: I googled AR 15-6 investigation. It pulled up a 38 page kindle document.

Not a legal expert, but he'd be facing an Article 32, no?

Not busting your balls, COL. Just curious if you know and can share more.

15-6 is an investigation or inquiry

Article 32 is a pre trial hearing

I see someone has been watching FOX news.

Try to keep up, low-info. This has already been tried and thrown out.

Based on my googling.... This is just not meant for me to understand.

I hope he gets whatever justice he deserves.

Rgr. Most times we hear about a case in the Navy it's either Article 15 (NJP or Captain's Mast) or it's already an Article 32 investigation pending referral for court martial or dismissal. I wonder if the Army does it differently or if I just don't have much insight into our own legal processes.
