I did question the existence of an "unwritten policy"... it almost sounds like a Code Red but nicer. Of course he may be able to dig up some cases from previous conflicts where someone was in some disciplinary trouble but the charges were dropped as they found their self a POW in the theatre of war before they were processed.

I am betting that Vietnam has a ton of examples.

If that fails I am guessing the fallback defense is an insanity plea.

You are guessing correct good sir. Another instance would be misconduct that occurred during the Korean Conflict (which led directly to the development of the Code of Conduct for military members).

He has a lot of good material to work with. And the guy is no slouch. He is top of the line.
