IRS "lost" my 9465. Suck it up and pay the penalty?

Penalty is not a huge sum, but it's fricking annoying. They took one payment already, but just sent me a letter stating that I have to pay within ~30 days to avoid more penalties and interest.

Been sitting on hold for 45 minutes.

Is this worth the fight, or should I just suck it up and set up a new installment plan?

How did you pay? Check? Card? If you have proof of payment that they received and cashed, fight it.

I received the same thing the other day. After speaking with the guy he told me to disregard the letter because they do have records of me filing the 9465. I asked if they could reverse the the late penalties and he told me o because since i am on an installment plan i am indeed paying late. Bunch of blood sucking bastards.

An installment plan prevents the IRS from taking more aggressive enforcement actions.

It does NOT stop the late payment penalty and interest. These continue to accrue until the balance is paid in full.

Those letters, when they calculate the total owed, calcuate out about 30 days of interest and penalty. That's why it says you have to pay within 30 days to avoid "more".

I got a letter from the La. Dept. of Treasury last year saying that I never filed a state tax return for 2010. I called their office and asked if they issued a tax refund check to me that season. They looked it up on their computer and said 'yes, we did.'

Me: Why did you send me a refund if I never filed my tax return?

Him: Oh yeah, never mind that notice. But if you have a copy of your 2010 return please send it to us because we've obviously lost our copy.

I called my CPA and asked him to send a copy. He said "Zach, this happens all the time. A lot of people in the Treasury Dept are absolute morons."

We get a lot of notices where a state processed 3 out of the 4 returns that were mailed together. Usually it's just a matter of sending them a copy of the return and a copy of the certified mail receipt that they signed.
