You might be forced to sell it if you say anything people deem as "offending" in private.

Maybe you should hire a lawyer to read a franchise contract if you ever plan on owning one.

Well since his franchise is under the NBA as a company he is getting fired so this analogy does not apply here.

There is a difference. It makes total sense that the NBA would protect its own interests.

Having said that, the latest stories on this is that the NBA players demanded the move and that they threatened to strike if it didn't happen. In that light, I think the OPs point is meaningful.

So in the Franchise contact it says anything you say in private deemed offending can make you have to sell? Who determines this?

All of this is correct. The problem comes in as to what constitutes offensive speech these days and the very narrow and selective words or speech that gets one in trouble. If for instance, in Mr. Sterlings conversation the words black man, would have been substituted for, Christian man, or right wing man, or most any other type man, nothing would have been said.

Depends on the contract language. Almost all franchise agreements have language regarding "actions detrimental to the franchise."
