A 7th grade school teacher removes a student from her class by...

The student refuses to tuck his shirt in and ignores her instructions all three times.

The police are called and the teacher is handcuffed and arrested and taken to jail for simple battery for pulling on the student's shirt.

There are no racial issues as both teacher and student are African-American.

There are some unbelievable stupid people in the Baker Police Department if this story is true.

As for the mother, who obviously initiated this arrest, karma is a bitch and it will come around for her sooner than later.

That's ridiculous.

My high school football and track coaches should be lifers in jail if that's the standard for simple battery.

Young male defies authority.....I see jail time in his future.

My how things have changed. There was time when each school day was started with the Pledge of Allegiance and students were punished with paddles for misbehaving.

Now you can't even say God in school without upsetting someone and if a student misbehaves the teachers get arrested.

The paddle licks I received for missing football practice one time would probably warrant the death penalty for a coach these days.....

Didn't this school district have a similar instance happen at the elementary school level?

(3) A teacher has the right to remove any persistently disruptive student from his classroom when the student's behavior prevents the orderly instruction of other students or when the student displays impudent or defiant behavior and to place the student in the custody of the principal or his designee pursuant to R.S. 17:416(A)(1)(c).

(4) A teacher has the right to have his or her professional judgment and discretion respected by school and district administrators in any disciplinary action taken by the teacher in accordance with school and district policy and with R.S.17:416(A)(1)(c).

I can't believe people used to get spanked by adults in school. There is no way in hell I would let somebody do that.

When i was in 7th grade in the late 90's one of my teachers got one of my classmates in a headlock and bodily threw him out the door because he called her a count. He got suspended and his mom forced him to write an apology to the teacher, who did not get in any trouble that i ever heard about (and considering that it was a small private school where it was impossible to keep anything a secret i think i would have heard about it if there was ever a real stink raised over it)

The teacher likely has a viable defense if the facts are the ones stated in the article.

See R.S. 14:18(4)

quote:

§18. Justification; general provisions

The fact that an offender's conduct is justifiable, although otherwise criminal, shall constitute a defense to prosecution for any crime based on that conduct. This defense of justification can be claimed under the following circumstances:

(1) When the offender's conduct is an apparently authorized and reasonable fulfillment of any duties of public office; or

(2) When the offender's conduct is a reasonable accomplishment of an arrest which is lawful under the Code of Criminal Procedure; or

(3) When for any reason the offender's conduct is authorized by law; or

(4) When the offender's conduct is reasonable discipline of minors by their parents, tutors or teachers; or

(5) When the crime consists of a failure to perform an affirmative duty and the failure to perform is caused by physical impossibility; or

(6) When any crime, except murder, is committed through the compulsion of threats by another of death or great bodily harm, and the offender reasonably believes the person making the threats is present and would immediately carry out the threats if the crime were not committed; or

(7) When the offender's conduct is in defense of persons or of property under any of the circumstances described in Articles 19 through 22.


Looks like Baker PD arrested a teacher for a "crime" that is likely barred from prosecution.
