On Friday, John Peter Smith Hospital acknowledged for the first time that Marlise Munoz, who is being kept on a respirator under Texas law, has been brain dead since November 28 and that the "fetus gestating inside Mrs. Munoz is not viable," according to court documents released before a Friday hearing.

Brain dead woman, non viable fetus. I don't see the problem.

Husband agreed with the decision as well.

This is what makes me mad, a fetus is not considered viable in Texas until after 24 weeks, and no tests have been done on the baby int he last week

It's a real shame this guy tried to kill his own baby.

This whole story was a compete clusterfrick and a sad story from beginning to end.

There are absolutely no winners in it at all. Everybody is a loser.

Another person who doesn't believe the "life-sustaining measures" are warranted is Tom Mayo, a Southern Methodist University law professor who helped write the law being cited by the hospital.

"She's not a patient anymore," Mayo said, adding that the hospital was misinterpreting the statute. "So I don't see how we can use a provision of the law that talks about treating or not treating a patient in a case where we really don't have a patient."

Local radio host Chris Krok here in DFW has been following this story from the beginning and is calling out the judge right now

He said the "non viable" fetus excuse is a bunch of malarkey because a.) Fetuses are not considered viable until 24 weeks and b.) No tests have been done lately, its all based on speculation about the deformities.

He went on to say how people born with deformities can still live a good life, gave an example of a baby born with only 2 fingers and mute, is now a disability lawyer.

Still doesn't excuse him from being a pathetic excuse for a human being for wanting to kill his baby....

wait is the fetus living and growing than why let the women die meaning the fetus will also die. If the Body is letting the baby develop why let the women die.

I have no issues with a court ordered removal of ventilator but because she is pregnant she should be kept alive until the fetus is viable

He did not kill his baby. His wife was without oxygen for an unknown amount of time and the fetus was never viable. Regardless of how you feel about it, his wishes should have been honored from the beginning. When it's your decision, your wishes should be honored without interference from the state.

but this is a death sentence for the fetus. But legally I guess the judge is correct but way off morally.

Its not a death sentence for the fetus. The fetus by all rights should be dead, and died when the woman carrying her went brain dead.

All the judge is saying let nature take its course.

Morality is not within a judge's purview. And again, the husband's decision should have been honored without interference from the state.

The hospital and the Tarrant County District Attorney's Office, which said it will defend the medical facility, did not offer the same level of detail as members of the Munoz family.

Late Friday, the hospital issued this statement: "JPS Health Network appreciates the potential impact of the consequences of the order on all parties involved and will be consulting with the Tarrant County District Attorney's office."

When there's something that bothers you that you can't possibly understand and about which you will never do anything, it's always best to accuse somebody of murder so that you feel better about yourself and what you don't understand.
