Supreme Court puts gay marriage on hold in Utah

Just saw this tweeted, although i didn't know any such big case was before them. don't really know any background yet.

A decision by U.S. District Court Judge Robert J. Shelby is the "starting point for resolution" of Utah’s right to define marriage, the state said in a reply filed Monday with the U.S. Supreme Court.
Until the "recurring" question of whether the U.S. Constitution requires recognition of such same-sex marriages is resolved, Utah should not be forced to license, perform and recognize such marriages during the interim, it says.
The state said attorneys for three same-sex couples who successfully challenged Utah’s ban on same-sex marriage "quibble around the edges" and fail to offer any persuasive rebuttal to the state’s argument that Shelby’s Dec. 20 order should be stayed while it appeals the ruling.
The plaintiffs filed their brief before the U.S. Supreme Court on Friday.
Utah’s stay application is being reviewing by Justice Sonia Sotomayor, who is assigned to the 10th Circuit Court of Appeals.

This ruling won't effect me in any way. I have only known a few Mormons outside of the missionaries and they didn't practice the religion, and I have no plans of accepting a invite by Toddy to a social event in the near future.

While this is disappointing, this is not a surprise at all. Frankly, I would have been astonished if they had not issued a stay.
This is Prop 8 all over again. Remember, the federal judge and the Ninth Circuit both issued stays after their rulings striking down Prop 8. The Utah AG fricked this up as he hadn't already requested a stay if the Shelby found Amendment 3 unconstitutional. There was no stay to put in place because the Utah AG had not requested one prior to the ruling. It is surprising (and possibly quite telling) that the Tenth Circuit refused to issue one though.
The Tenth Circuit could very well affirm the ruling striking down Amendment 3. And the SCOTUS could very well decline to hear the appeal reinstating marriage equality in Utah. If they decline to take the Utah case, they will probably take one in the next few years though. There are currently 31 cases in 17 states working their way up through the courts. I predict more rulings similar to Shelby's who used the DOMA ruling as justification for striking down the gay marriage ban.
The SCOTUS is not going to say it's illegal for the federal government to discriminate against gay people but then say the states can do this. The gist of Shelby's ruling was that individual rights trump states rights when the two clash.
At least that crazy Mormon politician who has been starving himself since Shelby's ruling can eat again. I've been getting worried about him. He claims he's already lost 25 pounds.

If California is any indication then the marriages will still be valid. If Utah wins their appeal, they could make them go through some kind of "forced divorce" but it's doubtful they would succeed. Some of the GOP politicians have mentioned converting them to civil unions. But they've already fricked that up as Utah also banned civil unions and domestic partnerships when they enacted Amendment 3.
