John Robert's lesbian cousin to attend Prop 8 hearing


She will sit in seating reserved for family and friends of the Chief Justice.

If Roberts votes to strike down Prop 8, will the gay marriage opponents accuse him of being biased (like they did with the gay judge Vaughn Walker, the federal judge who initially declared Prop 8 unconstitutional) ?

SAN FRANCISCO -- When the U.S. Supreme Court conducts a hearing Tuesday on Proposition 8, the lesbian cousin of Chief Justice John G. Roberts Jr. will be in attendance.

Roberts is a conservative appointed by President George W. Bush in 2005. Jean Podrasky, 48, who is more liberal and the first cousin of the chief justice, said she rooted for his nomination to be approved by the U.S. Senate.

"He is family," she said.

Podrasky lives in San Francisco and said she usually sees Roberts only on family occasions. His mother is her godmother, whom she said she adores. She said Roberts knows she is gay and introduced her along with other relatives during his Senate confirmation hearing.

She hopes he will meet her partner of four years, Grace Fasano, during their Washington visit. The couple flew to Washington on Sunday.

"He is a smart man," she said. "He is a good man. I believe he sees where the tide is going. I do trust him. I absolutely trust that he will go in a good direction."

Podrasky obtained the highly coveted courtroom seats by emailing Roberts' sister, Peggy Roberts, and then going through his secretary. Roberts knows she is attending, she said.

She, her partner, her sister and her niece will attend Tuesday's arguments on Proposition 8. On Wednesday, her father will take her niece's place for the hearing on the challenge to the Defense of Marriage Act.

The San Francisco-based National Center for Lesbian Rights, which has fought for marriage rights, invited Podrasky to do a guest column about being related to the chief justice. The column will be emailed to members Monday.

"Everyone in this country has a family member who is part of the lesbian, gay, bisexual and transgender community," she wrote. "As a Californian, I want nothing more than to marry my wonderful girlfriend. And as a tax-paying citizen, I seek basic fairness."

If you were anything near intellectually honest, you'd admit that there was a clear conflict of interest in this case.

Is this the lesbo cosa nostra trotting out family just like they did on Frank Pantangila in Godfather Part II when he was all set to testify against the Corleone's and they trotted out his brother from Sicily and "let him know what was up"?

Why?

Would there have been a conflict of interest if an African-American had been on the court for Brown vs. Board of Education? What about a Christian judge on a case involving prayer in schools or some other religious freedom issue? A woman on Roe v. Wade? Why should a gay judge be automatically incapable of ruling on an issue of gay rights?

This reminds me of the scene from The Godfather when Michael Corleone brought in Frankie Pentangeli's brother from Sicily to watch his brother testify.

How many folks on this board would feel comfortable if Dick Cheney were voting in place of John Roberts? On the one hand, he's about as hard-line a conservative as they come. On the other hand, the one issue on which he broke rank with W when he was Vice President was on the issue of gay rights, due to the empathy he developed as a result of having a gay daughter.

I think this situation illustrates how this issue affects so many families in this country, even the family if the Chief Justice.

On a side note, one of Scalia's sons is a former director of a "gay conversion' program. Do you think that will affect Scalia's decision ?

I would expect any judge with a potential vested interest in a specialized situation like this to recuse himself/herself in order to avoid even the appearance of conflict.

So, if a case involving religious freedom comes before the court, all religious members of the court should recuse themselves? What about atheists? Who would be left to hear the case?

If a gay judge should not be allowed to hear a case involving gay rights, then should a Christian judge also be barred from hearing the case, too? Wouldn't a Christian judge have a similar conflict of interest? Either judge should be professional and set aside personal feelings when deciding the case. Why would only the gay judge be presumed unable to do that?
