My grill isn't a open flame grill though.
It's a propane powered infrared based one.
Wonder if there is a legal leg to stand on with the distinction.
Getting the landlord to agree is another matter I know....but I'll worry about that later.
OT ballers who would simply buy the complex need not respond.

Just bring it out a few feet from the building. It really isn't that much of an inconvenience.

we were suppose to but we used a grill when it cooled off we just put it in the the outside closet

You been in many balconies in apartments that allow you to place a full sized grill a few feet from a combustible surface (including the fence), much less the legally listed 10 foot?

as long as there is an exposed flame, yes it is. unless your flame is fully inclosed within an combustion chamber and fully vented above the roof line, then NFPA code will apply.

That's the angle I would play if it came to it.
However, there are flames associated with an infrared grill.
They just aren't open/in a place where a grease flare up can happen.
If you take the grill apart you can definitely find a compartment with a flame. The main difference is that it is enclosed as opposed to open.
Hence the very fine line.

If it clearly didnt apply, I wouldn't have made a thread. 
Just wondering if anyone successfully BS's with the infrared line.
To the code it's a no go.
As far as safety goes there is a big arse difference between allowing charcoal grills and infrared.
Pretty much every grill based fire comes from a dumbass that either knocks the thing over, spilling charcoal everywhere, or uses something stupid like gasoline for lighter fluid.
No real difference in risk from allowing electric (which is up for code)

no there isn't. the issue is temperatures within the grill reach high enough temperature that combustion items within its operational range can catch fire, even without direct contact to a "flame"
you do know things can catch fire based on temperature and don't need contact with a flame right.
Put it this way, i'm and engineer and could not argue the point in my defense when i had an apartment. You will need to walk down stairs and cook away from the building. use this time to meet your neighbors, who knows you might get "lucky"....

You do know that you don't need a flame as a starting point to generate those temperatures?
If I'm forced to back down in my new complex, I am going to invest in a very high end electric grill, which is completely okay with the code, but will also generate temperatures in excess of 650 degrees.

I'm okay with charcoal being banned. You are building an moderately controlled fire and you aren't going to sit there till it burns out.
Propane should be kosher IMO.
