| Live in LA, work in TX; What taxes would I pay? (Posted on 1/18/13 at 2:16 pm)
Can someone help me out with this? Would I pay LA income tax?

I'm probably not going to be much help, but my wife works in KY and lives in TN and she does not pay KY income tax. TN does not have an income tax.

So I would think this would be right, but I have no idea.

You will pay taxes in the state you reside in. I accidentally forgot to change my address from Arkansas to Texas and for a couple weeks I had to pay Arkansas state income tax despite living and working in Texas.

You sure about that? I had to file a non-resident return with them for just a few weeks I spent working up there a couple years ago.

The way it typically works is that you would file as a Louisiana resident and pay tax on your entire income. You would also file in the state you work in as a Nonresident. Louisiana, your state of residence, would then give you a credit for the amount of taxes you paid pay in the state in which you actually worked. However, since Texas doesn't have an income, your credit is ZERO. Basically, you're really f*cking up living in Louisiana. You're paying state taxes you wouldn't have to pay if you were living in Texas.

Although states laws differ, I'm pretty damn sure that she does have to pay in KY as a resident and would get a $0 credit for the taxes she didn't pay in Tennessee. You should see a real CPA and not some jerkoff at the Jackson-Hewitt in Walmart or the H.R. Block idiot at Sears.

I use TurboTax, does that count? And it's also on a military base, not sure if that matters or not.

Well, I just checked up on it... From Wikipedia...
quote:
Kentucky has limited rights to taxation: Individuals performing services on the Kentucky portion of Fort Campbell only pay taxes to the state where they are residents, refer to US Code Title 4, Chapter 4, §115

Turbo tax should be able to handle it.

Yep, you need to fill out I think a w4 and give it to your employer so they can withhold your state taxes for you.

Newbomb never mentions his wife. You must be talking about me. I referenced the US Code above that exempts employees at Ft. Campbell from paying the KY income tax. It states they pay the income tax in the state they reside. So, I think with all the different opinions in here, they are all right if that makes sense. Best I could tell from looking into it is in most states, that is correct, you pay both taxes in the state you work and reside. So, my advice to the OP would be ask a tax professional in your area.

Along these same lines - what if you keep a second residence in Texas while you work there? Could you claim a Texas residence if you rented? What if you purchased a townhome in TX to live in during the week while you work there?

Obtain a TX drivers license and register to vote in TX.

Yes you would be a Texas state resident then.
