Socially Conservative feelings on Constitution



Being a Libertarian, which most red state social conservatives aren't fond of, I have upmost respect for our Constitution. I do agree Libs often decry the rules in the Constitution and attempt to by pass it. But, why do so many social right wingers ignore the minority protections in the Constitution? Things like gay marriage, when u can't discrimate specifically against gays via the Constitution, should be a no brainer. If you don't like the Constitution let's write an amendment taking away the provisions giving gays equal rights. And prayer in public funded schools when children, whose parents pay taxes, have to hear prayer from a different religion. Send ur kid to a private church school or pray at home. Why the need to infringe on other people's liberties? Is not thinking ur right and practicing what u believe in private enough?

I actually diagree. I find it fairly specific, with a little room for wiggle. Over time it has been bastardized and ignored by the court, but the document itself is still the best written set up of government ever done. IMO

I dont understand why you can't be libertarian and respect the constitution. It's not the document that is flawed it is the republicans and democrats who have ignored the basic precepts of it that have led to our authoritarian state.

How many Supreme Court justices does it stipulate? Could that ever be abused?

What does "reasonable" mean?

What constitutes interstate commerce?

What does "necessary and proper" mean?

Where does it say this in the constitution. Where in the constitution is marriage mentioned?

There are only 3 things in the constitution that are labeled "unlawful"; piracy, treason, and counterfeiting.

We now have over 4,000 federal laws.

IMO, the 10th Amendment has been long forgotten and the people let it happen.

This is actually a very sublime statement...

Governance comes from people. The paper merely exists to articulate what the people agreed to. If the people decide to redefine Governing, the paper will not prevent them from doing so..

The Constitution does not give the Federal Government the power to regulate marriage, leaving it to the States. And the States are handling the issue just as they should. If you think the Constitution mandates gay marriage be legal nationwide, you are NO Libertarian.

Indeed the states should regulate marriage and marriage is not addressed specifically, but discrimination based on sex or sexual preference is discussed and the state cannot infringe on those groups rights. As long as marriage is a government institution, which it is, it should be available to people protected by equality clauses of the constitution. Real libertarians generally don't care about issues like these as they do not affect other people's rights. Under libertarian principles u can do as u see fit in ur life, assuming it doesn't affect someone else. I feel the repubs would do better to employ this logic and concentrate on economics rather than people's personal business.

Thats great and all but the answer is to get government out of marriage, not to get government to sanction gay marriage. Letting the states determine what they want to do is ultimately the best way to do it.

It's called the non-aggression principle. And the NAP is in direct opposition of state governments as they can only exist as a government through aggression and coercion.

That would work well provided that Article IV is respected. A marriage contract (and a divorce) in any state should be binding in all states. It's the gay marriage opponents who are trying to subvert the constitution, not the other way around. This is the issue that ultimately will result in the Supreme Court stepping in.
