Trespassers and what to do

Our family land in Franklin Co., Ms has a creek on the south side that trespassers seem to like to ride ATV's on. The creek has sand and gravel bars that are very inviting to ride on. So today and about a week ago while hunting, I hear the ATV's going up the creek and then after a few minutes back down the creek. In the event I encounter these fine folks, (which I am attempting to do) can I "hold" them until the local LEO's arrive to issue citations or arrest them. Does anyone have experience in this matter? They are really starting to annoy me.

If you try to detain them, they have a gun and pull it, you willing to kill someone for riding a 4 wheeler on a creek at the end of your property?

Set up a camera and bring pictures to local police/sheriff dept and let them take care of it. ID them and press charges.

That is probably a better idea, cameras, but it sure pisses me off. I would never shoot a trespasser.

Honestly, there is almost nothing that you can do unless you can show some damage that they caused...if that is the case, you can go after monetary judgement, which will get some attention...

Your best bet is to find out where the park/live and try to get the local sherrif's deputy or game warden to hassle them....

Oh IT IS very pissing off. I would be mad too. Have had to deal with that before. Sometimes just "catching" them and telling them is enough.

If it's a situation in which the 4 wheeler riding has been going on it's even harder to break the cycle. Have you been owning the land and is this riding someting "new"?

Did you put up posted signs on the beach area? Nail them to a pole and stick them right in the middle of the 4 wheeler tracks. Maybe they've been riding there for a while and no one has ever said anything. They're not going to stop if they don't know they aren't wanted there. If they ignore the signs, I would try the camera. Idk how much you want to invest in catching them but if I wanted to catch trespassers I'd put a cam that sends pics to my phone. If they see your camera and steal it, then you have no evidence and money gone.

The close line method is a little harsh

I personally prefer digging ditches about a foot
Wide and 3
Ft deep. Cover with sticks and leaves.

Posted signs at entry points with a camera set up. Make sure that any picture that is taken can read the sign in the back ground. Having your name on said sign is a big plus.

Here in Louisiana, the law protects land owners. If you don't own it or have permission to be on it, you're trespassing. One of the best laws they passed here.

All else fails, a shite load of roofing nails thrown around the entry point.

Pretty sure creeks aren't private land. Even if it's running through your land. Or maybe that's only true for larger bodies, like rivers.

I believe it has to be navigable to be able to pass and if they are riding 4 wheelers in the creek that would mean it isn't.

The land has been in my MIL's family over 50 yrs they have never really enforced no trespass on the creek. I am now the enforcer.

Wow, a lot of hurt feelings in here. I would just go talk to them first. Not like they are trespassing, hunting your game. They are just riding atvs up the creek. I'm sure that a simple conversation would end it.

And maybe it only bugs you during hunting season, that would bug me. If you don't mind them doing it in the summer months, let them know. As long as they aren't littering or coming on to your acerage, it may not be a problem to you.

And whoever said they have fired over a trespasser... You're such a badass.

No, they're trespassing, there was a law passed a few years ago in Ms that addresses sandbars and such. Looks like signs are in order. I will "hunt" the creek tomorrow afternoon. Pretty sure they are local kids, I heard the loud pipes running up and down the road before I went in the woods yesterday and then heard the same pipes later on the creek.

Put up Posted signs errywheres. IR Cameras. They are prob riding at night too. If they see a flash it gone. Lots of pics. Send to LEO. Then pull cameras or they will be stolen.

Also, as you already understand, once you confront a local its on. you cant be there 24/7. So be prepared for retribution.
