That's a garter snake. The exact species will depend on the location. (Probably eastern garter unless you're out west or something)

I can't believe I always get downvotes for correctly identifying snakes on here.

Dekay's and Garters can look similar, as this one does. But it's a garter.

I'm going with teague on this one because of the head and the scale pattern on the side of the head (though you can only see a glimpse of it).

I do notice the stripe... on THAT one. But garters are quite polymorphic. They don't all have clear stripes, although you can see signs of stripes near the head and sides on the original photo. I doubt that the one in the OP's photo is even a checkered garter (Thamnophis marcianus). It's probably a common or "eastern" garter (Thamnophis sirtalis), depending on location.
