ETA: I followed the news site link, and it is in fact a Copperhead. I'm called BS on the size though.

It was a Lowe's employee.

Does this fall under Worker's Comp or does this guy get paid? Paging TD employment lawyers.

yes, work comp definitely picking up tab. he may have to prove some sort of negligence of lowes to get paid but i'm sure he'll end up getting money one way or the other.

It wouldn't be hard to get right under the fence, especially if there was a wooded area nearby. He could have ridden right in on a pallet from the nursery.
