Buddy tried to purchase a pistol this weekend

And he didn't pass the FBI background check. He got a paper with info to appeal the decision. Problem is he's unsure what caused the denial. He's in his early forties and had 2 DUI's in his early 20's while living in another state. From what I've read misdemeanor DUI doesn't prevent firearm purchase. Any advice on what he could do or how to find out what caused the denial?

It's not the DUI that's stopping him. Could be something he's not saying or could be a mixup. It happens.

I forget the actual process, been out of retail a while. There is a way to contact NICS directly and find out what the denial was for, I think via a form you send in. Where he purchased the gun should be able to help out with that.
While they can cause a delay, DUI's shouldn't cause a denial.

It was Jim's in BR but he asked several questions after the denial and they never gave him any advice and just repeated that there was nothing they could do.

Yeah the people at Jim's won't know why. When I worked In a shop that sold guns a few years ago, they wouldn't tell us why. We just gave the customer the info, (a pamphlet if I recall) It was up to them to appeal, if they so chose.

All he can do is contact NICS, the shop doesn't know dick. All they get is a DENY on the check. He's probably lying to you and doesn't know what happened. Don't buy anything if he asks

When I read stories like this, there is always another component, like the felony DUI, or domestic abuse charge, or the battery charge they seem to forget to tell you.

I certainly won't be doing this. His initial fix was to have his wife do the background check and make the purchase. But he still wanted to know why. Looks like he'll be able to find out. He's been going with me to the range and getting some training at Precision and was ready to purchase his first firearm. Needless to say he was gutted when he got denied.

Guy who owns a pawnshop told me the majority of people he deals with that get turned down is due to a restraining order. He said people will go through a divorce an ex wife will get a restraing order against them and they never have it removed. Guy comes in a few years later to buy a gun and it still shows up on his record.

What's really weird is my brother will sometimes get an all clear on a purchase and other times, like last weekend, he got a delay.

The "problem" whatever it was, was not cleared up after 72 hours, so he was good to go after that.

If he got denied, he needs to find out why because if Im not mistaken, the FBI took all its employees that process appeals, and sent them to the NCIS background check departments because of so many gun sales. There is no one to do appeals until they appoint people.

For denial and not a delay? Oh,my guess is a misdemeanor domestic violence,or a mix up.

Don't know about there,but in Al. if you get a Concealed carry permit,you can bypass the NCIS check.
If he tries this, he will probably find out why he got denied.

I had it happen to me recently. You can request the reason from the FBI and they will send you the answer via US Mail. FWIW, I had a similar name to an individual that was prohibited. I sent in my fingerprints to the FBI and I now have a UPIN (unique personal identifying number) that I use when I purchase a gun and now have no problems.
