Anyone have a clue on this?

Give it time to shake out, that is what I am doing...

You want to sue because your emitions are higher than you thought?

Volkswagon is in negotiations for a device that installs in the emissions stream and corrects the problem.
Hang tight & great chance you'll be alright.

What damages do you wish to recover with your suit?

I am trying to figure this out myself.
Who buys based on emissions?

No one. Definition of a frivolous lawsuit.

It's an emotion about an emission.

I would be down with awarding a settlement to people who have an established record of buying carbon offset credits prior to the revelation.
Award them enough to buy the additional credits needed.

No dick but if I'm forced to bring it in on the recall I will lose my mileage which is the only reason I bought it.
My losses are nothing right now but could be great if I have to bring it in. Also, I can't trade it in due to the issue at hand. Or so I'm told.
There is the diminished value of the car to consider. I thought you tools were smarter than this.

Dealership is 8 miles from his house, plus round trip, may even have to make it a few times

Are you kidding. My car may be required to have emission system overhauled in order to legally get an inspection sticker. That overhaul will likely take my mPG down significantly. So I now paid for a car that doesn't perform as advertised. Plus resale will drop. Already seeing like 3k losses in blue book values. It's not "I want your money because of emissions".
