Cork any idea why this guy isn't on trial for first degree murder instead of second degree since the murder happened during an aggravated burglary or armed robbery?

No chance an Orleans jury goes death on a case with these facts. No point in needlessly forcing yourself to get a unanimous verdict when you get the same inevitable life sentence with 10/12.

Probably going for the easier to prosecute route. 1st degree would probably be more risky than seeking 2nd degree.

But second is a responsive verdict. So if you don't get first degree then second is right there for the jury to choose

And you only need 10 out of 12 to convict him on first degree (incorrect). It's the death penalty phase that requires a unanimous verdict.

The craziest thing about this case to me has always been that I had Joshua Lee under cross examination in criminal Court just a few hours after he did this. He was a surprise witness who was not disclosed to us, and I remember asking him for his name as he sat there so I could have my investigator run his rap to impeach him. To think you can do this and then show up at Criminal Court to testify for another murderer right after just blows my mind.

Nope, unanimous verdict required in the guilt phase as well.

Cases in which the punishment may be confinement at hard labor shall be tried by a jury composed of six jurors, all of whom must concur to render a verdict.
