Two marijuana users in Colorado have filed suit against a pot grower they say used an unhealthy pesticide on the weed they later bought.

The lawsuit filed Monday in Denver is thought to be the first product-liability claim in the nation involving the legal marijuana industry.
It underscores growing anxiety and continuing disagreement over the lack of regulations about what chemicals and pesticides should be allowed in the growing of pot.

The lawsuit targets a Denver-based pot company called LivWell.

Denver authorities seized thousands of LivWell’s plants earlier this year saying they had been treated with a pesticide that is legal for use on food but not tobacco.

The company insists its plants are safe and the plants have been released after testing at acceptable levels.

Good. If you use unhealthy pesticide and it hurts someone, you should be able to be sued for it.

I'm shocked and chagrined, mortified and stupified, that a pot producer would try to poison their consumers with such unsafe and hazardous chemicals.

legal weed

I still don't get this. I know Colorado has passed a law making it legal in their state (smart move IMO) but it's still very much illegal by federal law everywhere in the US, including Colorado. I know we've got a POTUS in office right now that's content to let this go on, but he'll be leaving office pretty soon. What are the folks in Colorado and any other states that have legalized pot going to do if the next POTUS decides they will actually enforce federal law when it comes to pot?

(And just so there's no misunderstanding, I don't personally smoke pot but I do support other's rights to do so legally if they so choose.)

They started selling legal weed in Oregon last week. I bet they use that as an election issue: "Republicans will shut down all the pot shops, so vote Democrat."

i have a really hard time seeing a new president "shutting it down" so to speak. Especially if it is a democrat.

The only one I can recall saying anything about it is Chris Chirstie if I remember correctly. Seems like he went on record as saying he'd shut it all down. I've not heard anything about it from the other candidates.

This needs to be addressed immediately and is one of the biggest issues in the industry. The fact that anyone can sell a product to a dispensary without it being tested/inspected is very alarming.

Cut their losses and move back to being a medical shop or close down. Much less revenue, but what can they do?

That's the point. I think it should be legal. My thoughts on the matter is it should be regulated pretty much like alcohol is today. Must be an adult to buy, possess, or use. Cannot operate things like cars, heavy equipment while under it's influence. In short, if you're a grown man or woman and you want to smoke or eat pot in your home, it should be no different than you going to the fridge and grabbing a beer.

Be careful what you ask for. Soon enough, the feds will be all up in your place imposing impossible regulations.
