Doesn't have to be all or nothing. Seems like he would have killed the officer earlier if he were really this intent on revenge and unconcerned with getting caught. But perhaps he knew that famous black New Orleans figure Will Smith was friends with a guy he thought killed his dad and despised him because of it. A previous hatred for Will Smith makes a bit more sense than getting that impulsive over a road rage incident.

Why would Hayes remain at the scene if it was a planned hit? That's a shitty plan and a shitty area to do a hit on someone
This Hayes guy seems somewhat familiar with the legal system judging by persuing charges after his pops was murdered. He's going to lawyer up, claim he felt threatened for his life by Smith. Smith may or may not have a firearm on him or in his vehicle. I don't think this is an open and close case

Not saying you're wrong, but if that's actually true then that is by far one of the most ridiculous reasons to kill someone, especially someone that should never have been involved in this. Besides being a friend of the officer, WS had zero connection to this case that happened 11 years ago to my knowledge.
The article does mention Hayes' father being mentally unstable. I guess it's safe to say that was passed on to him.

Hayes better hope Smith had a gun in the vehicle.

Smith's wife and Thomas could be a witness and say it wasn't a gun but his wallet. Again, we will never know and I am speculating like everyone else but it seems plausible to me.
