Texas Roadhouse rejects over-40 job applicants as 'Old 'N Chubby' (lawsuit)

The defense not only argues the discrimination charges against the company are wrong, but that EEOC has no authority under the law to bring systemic cases.

Among the evidence the agency has presented, according to the news site: job applications from 38 restaurants in 20 states, on which company officials posted yellow stickers with comments. Besides "Old "N Chubby" they included "OLD," "little older lady," and "middle age ... Doesn't really fit our image."

Not a whole lot of standard error in those statistics when you have that much of a sample size.

No, but the stats presented still don't paint the whole picture.

How many total 'front-of-the-house' applicants were there, and how many of those were people over 40.

I can't believe they are dumb enough to have company wide stickers with old or ugly on them. How does someone in a management position approve something like that?

My kids elementary school didn't have a single male working there. Did the EEOC investigate them?

Texas Roadhouse is not bad when you are stuck in a hotel for work and it's within walking distance.

It's doubtful that they had more than 0,1, or 2 male applicants
