Termite contract for Uptown NO - damage clauses

For those of you who live in Uptown New Orleans, does your termite contract come with a damage warranty? For example, if there is new damage after treatment, the company will pay to have the damage repaired? I recently got a quote from Terminex and the contract explicitly states that the company isn't liable for any past, present or future damage cause by wood-destroying insects.

That is standard language in a termite post construction contract. That language is from the Dept of Agriculture and Forestry. It will come down to does the company want to pay for it. Being Terminix, I doubt they will. Not saying they won't but you they are so big you are just a number to them. Once they get you they don't really care. I work in this industry and I'm not trying to blast Terminix. That's just typically how the national companies operate. All they care about is numbers. The smaller local guys typically will have much better service and claims process.

The standard post construction contract issued 90% of the time in Louisiana has no damage protection. It's simply a retreatment contract meaning they only have to retreat if you get termites again. some companies , mostly the national ones, have another contract that the state has approved for them to use that covers "new" damage. But with the formosan issue in NOLA no way would I issue one of those contracts there of I owned a company. "New" damage is pretty hard to prove anyway. They got a pretty good gig going huh? Politics at its finest. The Louisiana Pest Control Association is pretty good at what they do.

is it worth paying twice as much ($700 versus $1400) to get an "up to $250k" warranty? The second option is with a smaller, local company.

I want to say mine covers $1 mil in damages but I haven't read the fine print. Doubt they'd cover shite even though they did all the pretreatment and everything since.

We went with DA for that reason. We had the damage warranty in Baton Rouge with Terminix.

My parents got a new kitchen and laundry room in a raised house from Terminix. They paid without even as much as a hint of a fight.

Yep. Even after 20 years of treatment, termites had basically destroyed the back side of the house.

As long as you read the contract before you sign you should have the termite company by the balls when it comes to damages. You have to keep up your side of the bargain by keeping up with the contract details though.
And as far as the amount of coverage you have, anything over $50k is probably useless. If you have more than that in one claim, then its probably more of negligence on your part for not realizing that your wall has obvious signs of damage on it. Not saying it wouldn't be covered, but I'd think most people would notice damage before it gets to that point.
