Apparently an updated news story says he was cited with careless operation, not reckless operation... big difference. (a lot closer to the "failure to maintain control" I was talking about...)

When I was a kid in the 80s, we used to go on vacations with my neighbors, who had kids the same age as us. There were 4 kids between 2 families. The neighbors had a minivan. They used to take out the middle and back row seats and leave them at home, which gave us 4 kids a large area to sit, play, and sleep in. All the bags would ride in my parents car with my parents.

Of course, we never drived at night, and we never had a 16 year old driving.

That was 30 years ago. Times were different then... I guess people didn't think about it. Now, I'm nervous when my 6 year old rides in a car without her booster seat.

The photo of the wrecked vehicle on the advocate website shows 3 rows.

And I have a problem with the ticket because I'd put money on the line that the son didn't have a choice in his decision to drive. Dad said "you've got the 8pm to midnight shift, Mom and I are going to sleep for a bit and I'll take over at midnight."

This is tragic.
You wrote it correct though. The kids didn't know better and without knowing the ages of all occupants, I would assume at least some did know better.

I can't understand why some people don't use their seatbelts. As soon as a child is big enough to not use a car seat they should be taught to use seatbelts every single time they're in a vehicle.

so if this guy applies for a job in the coming years that requires he drive a company vehicle.....there should be no record of this event? I imagine the company's insurance provider would want to know if a person was involved in an accident that killed five people. This information may effect thier ability/exposure to want to insure him or not. There has to be a paper trail someone to mitigate the risk of reoccurrence.

It most certainly does. And the picture of the vehicle at the scene clearly show three rows of seats.

Isn't the driver responsible for ensuring all the passengers are buckled up? Sounds like he got off easy (from a legal standpoint).

It is incredible. All family members likely would have been fine had they been wearing seatbelts.

I think this is the take away from this tragedy.

Why is everyone talking about the ticket? Who really cares? There are five dead people in one family because no one was wearing seatbelts. The car did its job correctly. The passenger compartment was fine.

The take home message is not that some kid was given a ticket after a wreck killed five family members. The take home is simply that wearing seatbelts probably would have allowed everyone to survive if not walk away from that wreck.

After the fact, yes. Before the fact, no parent should put that kind of responsibility on a 16 year-old. I wouldn't and hopefully neither would you.

I'm very happy the judge dismissed the ticket and honestly expected it to go this route. DA Jerry Jones told The News-Star that the 16-year-old has been punished enough, and there's no need to add to his pain, which is true.
