Sometimes we call that justice.

Listened to it, it wasn't really that bad. Yea it sucks cause they were young but the chances of them not getting shot that night go up exponentially if they don't break into the house. Let alone the same damn house for the third or fourth time. Not only were they dumb enough to do it, they were dumb enough to suck at it.

Here's a summary from wiki
quote:
Smith had been burglarized at least half a dozen times over the past few months. Among the items stolen were thousands of dollars in cash, the watch his father had received after spending nearly a year as a POW in World War II, medals and ribbons Smith had earned in the Air Force during the Vietnam War, several firearms, and jewelry.
quote:
On November 22, 2012 (a Thursday), Kifer and Brady broke into Smith's home. Video surveillance captured the teens casing the property prior to the break-in. By his own account to police, Smith was in the basement when he shot Brady twice at the top of the basement stairs, and once in the face fatally after he fell to the bottom of the stairs. Minutes later when Kifer entered the basement, he shot her at the top of the stairs. Wounded, she fell down the stairs, and after Smith's rifle jammed, he shot her multiple times in the chest with a 22-caliber revolver, dragged her across the floor to set her beside the body of her cousin, and then shot her fatally under the chin. Smith then waited until Friday to have a neighbor call police, saying that he did not want to bother law enforcement on Thanksgiving
quote:
Legal analysts have stated that the initial shootings most likely would have been justified under Minnesota's Castle law, but that the subsequent shots were not justified once any threat had been removed. Sheriff Wetzel said that the law "doesn't permit you to execute somebody once a threat is gone." Hamline University School of Law professor Joseph Olson: "I think the first shot is justified. After the person is no longer a threat because they're seriously wounded, the application of self-defense is over.
quote:
Smith was found guilty on two counts of first-degree murder with premeditation and on two counts of second-degree murder after three hours of jury deliberations. He was immediately sentenced to life in prison without parole. The audio recordings were named by the jurors as the biggest influence on their decision. "That was the most damning piece of evidence in my mind," Wes Hatlestad, one of 12 jurors, said following the trial. "That audio recording of the actual killings and the audio recording of Mr. Smith's interview immediately after his arrest ... pretty much convinced me that we were dealing with a deranged individual.

I get that the Old Man was crazy but I think he was pushed to the edge after having all of that stuff stolen. The sentimental value of all those things must be tremendous, his father's POW watch and his Nam war medals. Probably doesn't have much to live for and they took away some of the most valuable things in his miserable deranged life. Not saying he was justified but damn, those kids were stupid assholes playing a stupid a-hole game. This time they got the prize.

I don't understand how insanity wasn't part of his defense. The recordings alone should show he was off his rocker.

It's creepy but ep. 20 is far more disturbing. Computerized voices narrating message board threads on child abuse, mutilation and cannibalism. It's awful.
Dear god. I decided to listen to all of the episodes starting with Ep 1. Just started 20. I started out ok but then my sons face ended up in my thoughts while listening to the voices. Almost instantly I wanted to murder the frick out of the people in that chat room. And not efficient murder. Like murder that takes 4 days. frick that is so disturbing.

But he murdered them. Listen to the tapes. He shoots them and disables them and stands over them and kills them. All while he is talking to them and himself.

Creepy or not, you break into someone's house you deserve to die.
He had shitty lawyers.
He had shitty lawyers.

Great podcast. The Luka magnotta one was probably the most disturbing IMO. Episode 33.

Doesn't seem he did anything too awful. He shot them both and finished them off. fricked up by not calling the police immediately.
"Finishing them off" is not legal. He executed the girl when she was clearly incapacitated and not posing a threat to him. That was murder, plain and simple. They should have gone to prison, not be executed by a vigilante.

vigilante justice is still acceptable to a large portion of our population.
At times it's acceptable. It's probably no worse than our corrupt criminal justice system.

Listened to that one the other day.
I was waiting for him to be not guilty due to insanity. Then get out in a few years. For those not familiar with Canada (some example in the same podcast series), nut jobs consistently get found not guilty for some really fricked up shite and get out years later with no supervision

I don't disagree one bit. I think the old man is crazy as a shite house rat. I also think his craziness is partly the responsibility of the dead kids who robbed him repeatedly. Did they deserve to die? I don't know. I do know they wouldn't have died at his hands if they hadn't gone to rob him AGAIN.
My bigger point is that the narrator, IMO, tries much harder to make this old coot out to be a monster than he did the child molesters/cannibals in the other podcast.
This old man was a wimp compared to those sick fricks. All this old dude did was kill a couple of delinquents. He didn't torture them or make them suffer.
Compare that to the child killers in the other episode and get back to me.

Based on the tapes he clearly murdered them.
His lawyers were shitty because bad it seems they didn't use some sort of insanity plea which was also clear from the tapes.
And I agree the narrator went overboard in his portrayal of the geezer. He doesn't compare to 99% of the other people featured on his show.

I don't know or care anything about any of that because I don't listen to the podcast, so I don't know what any of that has to do with what I commented on.

That's one of the Canada examples I'm referring to. I mean wtf how the shite is that guy out? He should at minimum be in a mental ward for the rest of his life.

Right. Just like you didn't know anything about what I was commenting on. You took it out of context. Same as with this thread and the podcasts
