No doubt.
He's iin the left lane (maybe he couldn't get over to the right, IDK).
He can pass other vehicles, even if he's slow.
That said, he was clearly distracted.
I personally think he deliberately sped up and knew she was there.
The old "cutoff" move.
But let's say he didn't.
That means he wasn't paying attention.
So yes, he definitely had some fault.

People trying to justify the girl's driving are some of the worst assholes on the road.
You want to pass? Get in line like everyone else. Truck driver did absolutely nothing wrong. He was in the passing lane, he was passing, and he was driving with the flow of traffic. She was the one being the a-hole.

He owns the space in front of him?
When she merged, there was enough room. And again, no one was breaking in front of her, but the space got smaller quick most likely because he decided to speed up.
I really think it came down to her being dumb and the truck driver trying to use his size to bully her off.
I wonder at what point though, she was considered to be in the left lane? At one point, she has both her wheels in the left lane with the truck completely behind her, but she didn't even have half of her vehicle in the lane at that point.

If someone actually cuts you off and you don't brake, then that means you hit them from behind and are 100% at fault.

If someone's careless action puts them in my path or in harms way and I kill them I can't be held liable. Someone pulls out of parking lot not paying attention should I risk harm to myself or others? Yes if I avoid great but if I don't I won't be held liable

Not gonna argue on my phone, but cutting someone off pulling out in front of that person is definitely considered in the defense of the person hitting the car in rear

If the person is fully in front of you, they have the righter way. The cop and insurance won't be there to see you get cut off, they will see that you hit someone from behind. You expect the other person to say "Oh yeah, I cut him off and it is all my fault he hit me from behind"?

Want to pass? No problem. Simply get in the line of other cars that are passing, and continue on your way.

I started playing a game with my s/o. Whenever we are out of state and I see someone driving terribly in traffic, I guess if they are from Louisiana or not. 95% of the time, they are.
