Rental Property Question

I have a tenant who is allowed two parking spots. She uses one regularly, the other she keeps her broken down car in. This car has been broken down for at least a year. This prevents me from accessing a tree that is over grown and can potentially cause damage to her car. It is my understanding from a little research that I can't legally tow her car unless it is in the lease. It isn't in the lease. I inherited the tenant when I bought the property. People do this forcefully though. So, how should I proceed? I've asked the tenant several times to take care of it. Car is still there.

Why even bring up the "tree"? Is that your excuse for demanding she move the POS? Just man up and tell the bitch you don't want trash parked at your property...... fricking land lords...

Just for your safety, pay for a certified letter saying the same, make a copy.
Have it towed at their expense and hopefully get rid of a bad tenant in the same breath.

A lot of parishes have ordinances that non-working vehicles must be repaired or removed from residential lots (see: Question #2 at this LINK). I would check with your parish and see.

Can't you just wait for the lease to expire and not renew it, doesn't sound like a good tenant anyway. Does the car have to be removed before then?

Send her a letter telling her you will be doing some repairs/striping of the parking lot on a certain date and that all cars have to be moved.

You can also just let her know that the lease will not be renewed if she doesn't remove the vehicle soon.

Sometimes the lease will have something about allowing access for maintenance.

Are we to assume your property is in Louisiana or should we give you a summary of rent law for all 50 states?

is this LA? did you assume the lease when you purchased the property? Did the tenant record the lease before you bought the property? if in LA and the answers are no, she has a lease with the seller, not you.

I'm pretty sure that wouldn't have to be specified in the lease in order to request a tenant to move one of their possessions in order to perform necessary maintenance on the property.

What a strange scenario/query.

There has to be something in the rental lease about keeping the place looking decent. Thats your ticket. Just because the old landlord didnt enforce it, doesnt mean you cant.
