Question About Auto Insurance and Body Shops Flooding

As if I don't have enough shite going on, my Truck is in the shop, which I think took on water. Who's insurance covers that?

Your insurance covers it. Had a car stolen out of a mechanics shop and it was on me and my insurance company to make it right.

Probably yours, unless you sued them aganist their liability policy. But, they probably have something in the fine print about not being responsible for act of God damage while on their premises.

Thinking yours as flooding there is probably the same as if it flooded at some other place that isn't your garaging address. Your insurance should cover it.

Why do you think the shop should be liable? What negligence on their part caused the flood? Act of God covered by your comp.

Would be a comp claim under your auto policy, hopefully you have comp coverage.

Ah damn, good one.

Yeah OP, just call the auto shop and be like "Pay for my car because bailment law." You should receive a check in the mail within a week.

Pretty sure it is yours. The situation is called a bailment and the shop owner is responsible for reasonable care. This was an unforeseen event and the shop will not be legally liable. They may have a bailment blanket coverage thing but I would assume it is on your policy. Your insurer can charge back for the deductible on your behalf if there are grounds for it.

What if its in the shop and another insureds is paying for your repair

Beacuse they wrecked onto your car

Reminds me of after the flooded car work in 1984 at Norton Buick in Tulsa...

Driver for the dealership (located in downtown with all the one-way streets and typical downtown parking stuff) backed a DeLorean into a brick wall when it was in for general regularly scheduled maintenance, after the detail guys signaled him to peel out (manual transmissions in DeLorean's have Reverse and 1st in similar positions).

Unpainted, stainless steel body, with creases from impact across both rear quarter-panels...dealership spent months trying to find her another car and the driver had to find a new job.

Same guy had been fired from a quick change oil shop for failing to replace the drain plug in a brand new ZR1 Corvette resulting in that place buying a new engine for their customer.

Was curious about this myself, my car was at the dealer getting warranty work done, so may have the same thing.
