OT legal eagles chime in: back injury while on vacation

So very early into our vacation, I sat in a swing that fell. Thankfully my legs weren't under it but a few days before I'd had injections into a part of my lower back. The Dr told me nothing strenuous for about the first week.
Also, I'd had a torn disc in my back that starting easing off but after that fall has started bothering me again.
The property owner has been very accommodating in his offer of assistance. My vacation was basically ruined since I was in so much pain the whole week and I'm back to square one with my back.
I have an appointment with my Dr this week but should I talk to a lawyer?

Sometimes adults shouldn't be on kids playground equipment.
