Did he go to court for the dui? Pay the fines? Do what the judge ordered regarding classes, aa meetings, etc.

If first dui and he did all those thing he should have had it back within a year most likely, evened without a lawyer.

What are the details of his DUI?

A DUI one, for a person with no priors, likely to be disposed of with a probation and 894. When the probation is over, the lawyer files a motion asking to dismiss the case under 894. This ends the criminal suspension. So, only the admin suspension and the reinstatement requirements are left.

Thanks for a decent answer. This person simply didn't show up for court and forfeited his license. Now, he's older and wants to get it all straightened out. He's trying to avoid having the embarrassing machine in his vehicle.

that makes more sense.

If he drives a vehicle at work, he does not have to have the interlock device in that car.

They will require an interlock. How long depends on several factors. Did the DMV tell him how long he'd have to have the interlock?

Buy a POS car or have it installed on a secondary vehicle instead of your daily driver.

He just needs to go to the DMV and get it reinstated, will cost about $500

Not so fast my friend. Those fees go up the longer you're license has been suspended. I'm not sure what the max is but its certainly over $500 after 6 years. As for the rest of it you may be correct if its simply a suspended license issue. However in this case there may some sort of flag/hold in place that only the judge can lift because of the DUI.

OP, I would try to go to the DMV on your own first and see if you/you're friend can pay the fees and have license reinstated. If that's not possible then lawyer up. I wouldn't expect it to cost 10-15k, probably more like 3k if there's no other legal matters at hand. First time DUI is fairly common and can probably be resolved with some classes and/or community service

ETA: I'm not a lawyer and this is only my humble opinion.

You should have thought about all that before you got a DUI.
You should have thought about all that before you skipped out on court
It's time to face the music and quit making excuses.

Assuming it was not a felony DUI (3 or 4 +) it should not take anywhere near that much to fix the license issue.

Not if he followed everything the court laid out. Doesn’t sound like this is the case. If he didn’t show up for court and has a bench warrant and a suspended license it will cost every bit of 15K in attorney fees to get his license back plus all court fees that have accrued over the years.

If he completed his probation all he should have to do is apply with the DNV to get reinstated. Odds are he won’t be able to afford car insurance. If they find out he has been driving without for 6 years that’s going to be no bueno.

Hmmmm…doesn’t sound too bad. Probably not much more expensive than an Uber.

Thanks!

I know a guy that went 9 years same story.

He showed up to the original judge, showed he was doing the right things ever since like recovery, and got the whole thing tossed. Got license at DMV a few days later.

Rule number 1, under no circumstances should he admit that he didn’t have the machine installed. Push it back on the county that their records are wrong.

Have him go here and check the status of his license online, and then go from there.

Express lane

I always abided by what the court told me to do. Never had a problem keeping insurance or license. Did have to install a breathalyzer 6 different times. Did a few defensive driving classes. Went to AA meetings. Did my community service. Met with probation officers and did drug tests. Paid a ton of money to lawyers and the state of Louisiana

I think that’s about it. They just want your money

Also the DMV won’t reinstate his license until all of his court fees are satisfied. He also more than likely has an open bench warrant for failure to appear. He needs to contact the court and get that started. The court will probably work with him to pay the fees and fines on a time pay.

But, when he went to get his license, the DMV still insisted that he have the machine installed in his car. Their position was that you do not have the option to simply quit driving in lieu of having he breath tester in your car for the designated period of time.

Yep it’s all about them getting their money

I asked the same question too

Yeah I fricking know. Just by missing a court date, one that I initially went to but the judge postponed for 3 months, cost me 45 days. So this dude needs to get that straightened out first.
