People on low/no carb diets, especially ketonic diets, have been known to register higher BAC readings than the amount of alcohol they actually drank.
ETA: obviously not what guy in OP has but helps to illustrate how inconclusive these machines actually are.

had a friend with this condition...he was an RN who damn near got fired for what they thought was showing up for work drunk despite the fact that everyone knew he didn't drink.
it's caused when one has a gastric yeast infection...usually the intestines...and upon eating any bread or pasta or the like, the yeast will mix with the wheat and glucose (upon being broken down by digestion), start the fermenting and the result being alcohol.
in short, your gut "auto-brews" its own beer. hence, "auto-brewery syndrome."

If he knew he had that and still drove he was knowingly breaking the law, even if he hadn't consumed any alcohol. Even if he didn't know he still was breaking the law but I would give him a pass the first time.
