O/T managers- Doctor's notes

Last week, I had a guy take off because he said that he had a Doctor's appointment. When he came back the next day, he handed in a note from the doctor. I didn't look at it closely until a couple of days later and realized it was from a woman's clinic. The letter excused him from work for the day. I was already a little put off, cause he said that the appointment was for 11 am (my workers start a 6 am) and he didn't come in before or after the appointment. Now I'm thinking that the appointment wasn't even for him. But was for his girlfriend or a girl he knows (I don't think he's legally married).

So can a doctor's office give him an excuse like this? Just for being somebody else's ride?

I'm thinking about calling the place tomorrow to do some follow up, in a vague kind of way. But I'm kind of thinking that it might be a fake or somehow altered. Anybody have any experience with this? He has no sick or vacation time available and he did this on a Monday. It is just kind of suspicious..

I'm sure the OT is going to provide real insightful information for you to base your decision making...where are you a manager, jiffy lube? I bet you wear a name tag.

You mad because he played you for a fool. Tell him good job and that it won't happen again.

As a manager it's really not your business why he's called in . Unless he abuses it.

Yep, I wear a name tag everyday. Company policy. Don't blame me that you can't change your oil.. sucker..

First thing is that if he had an appointment then he would have known ahead of time and should have let you know so you could plan for his absence.
Second, he should have called you before work that day to tell you he would not be there.
I would warn him to let him know you're on to him. Follow your company policy for disciplinary action.

Yeah that's going to be pretty pointless. I am pretty sure them telling you anything about his/her case is a HIPAA violation. How would you feel if some random telephone guy got your medical records over the phone?

Yeah, I wonder how ObamaLackofCare is going to impact this stuff. Many employers require some sort of medical note on sick leave and such. How are people going to do that when it takes them forever to get appointments and waiting hours in an ER is likely worse than sitting at home sick. If you can sit in an ER you can probably sit at work. If you are feeling so bad that you don't can't even get to a doctor but it's obviously not 911 time, then what are people supposed to do?

Simple answer is that sick leave disappears and employers just go to basic leave, you use it how you use it.

You can fax or email a copy of it to them and they can tell you if it is real or fake.
It has nothing to do with your medical records.

The note probably just says that he was in their office, which he likely was

Not saying he couldn't work and can return on such and such date and time. Take whatever action you'd take in that situation

Being that it was a woman's clinic, obviously they weren't seeing him, and they aren't going to tell you anything due to hipaa

Yeah, I would never do that. What I'm stuck on is can you get a doctor's note for driving somebody else to the office/clinic? If they did, would they just excuse you for the entire day? It just seems a bit off and kind of dishonest..

Checking the validity of the Doctor's note is pretty simple and no conflict there. I'm not expecting any issues with that.

Is he a good employee other than possibly abusing sick/leave time? If so, cut him a break. If it continues habitually, cut ties.

If you or your company offer sick days, you can't do anything on how he used them. It's like vacation. You don't have to offer it but if you do, you have to pay it. Now once he's exhausted those days, you can decide where to go for excessive absence etc. it all needs to be documented. If you have polices set up (any sick day has to have a Drs note ) you may have a case however unless it states that it your companies policy that sick days only apply to the employee and no one else you really have no way or leg to stand on. Even if you do, if you fire him, I don't see any labor board siding with you for this one instance.

To me it sounds like

1he had to take his girl/wife/mother/side piece to the dr and did the right thing by showing you the note that he wasn't full of shite. Sounds as if you guys don't have a policy on sick time so he was showing you he really didn't get drunk the night before and decided to sleep in
Or
2. He didn't want to come in and got a fake note. Either way, if you want to fire a guy over one sick day, it seems there is more problems there and you need to document them better to have a fire able offense.

Only worked for BIG business for 2.5 years, but if the criteria is a doctors note then he gave it. I had an OB/GYN write me one during my 2.5 and it flew no questions asked.
