Thank you for the clarification. The problem that I was worried about is I move everything to savings and try to keep little in my checking. I was worried about an overdraft if they pull it out.

Yes they are allowed to get it back, come on man! Also, do you really want to have this fight with your EMPLOYER????

Maybe. And perhaps so in this scenario. But what if your insurer miscalculates your overpayment, pays you, and you put a downpayment on a house bigger than you otherwise would have?
There are usually statutes or doctrines addressing such issues with payment recoupment. I don't practice in VA so I don't know if they have such a doctrine or whether it would apply here. If you can't repay the money, or don't think you should have to, get a VA attorney.

I think what he wants to know if they will just ACH it out of his account.

I gather that as well. I also take it that he has mostly everything swept from his checking to his savings account, and therefore might not have enough money for them to pull it all back out at once. Simple. Just move the overage from the savings account to the checking account and be done with it.

There's a difference between truth and trust.
Veritas means "truth" in Latin. Correct. It is also the name for the goddess of truth in Roman mythology. But it is also the name for the Roman virtue of truthfulness, which is defined as "honesty in dealing with others."
So yes. Your name is ironic.

And honestly, I was a bit harsh. I understand where you are coming from, and I am a terrible human being in so many ways. It's all good in the hood.

Yeah, apologies if I came across as a stealing little bitch, not my intention and the words protection and negotiating definitely conveyed that.

Snowball stands make bank during the warmer months. Tell your boss he should be able to afford it

C'mon. Admit it. This is what you were like after you got that check:

If you bought a sandwich and accidentally handed over a 100 dollar bill instead of ten bucks, would you think the restaurant can give you the difference in weekly increments?

If you'd talked to them you could already have arrangements worked out to rectify the situation in the time it took for this thread to run its course.

You should contact the payroll department and ask if they are going to ach or if you could simply write a check. Depending on state law they do have the ability to pull it back if an error was made and you agreed to such remediation when signing your DD agreement. I've had a situation not similar to yours where I had to pull back monday from an overpayment and the employee then quit..
