In Louisiana, the pedestrian in that video would have been ticketed for unlawful obstruction of a public road.

Say I run into the road to chase my dog in an attempt to retrieve the dog - while in the road I am struck by a vehicle - I will receive the first ticket. The driver may be subject to DWI, speeding, seatbelt law, etc.

Additionally, I can pursue civil action against the driver - I could depose the driver and access cell phone records to see if driver was texting or using data during the time of the incident - or possibly driver was not focused because his passenger was servicing driver with a handjob - if so, I will get a settlement.

We are waiting Louisiana legislature.

Yeah, because nobody has even been cited for a traffic violation in a parking lot. Failure to yield and improper backing seem like 2 favorites for citations written exactly where I described.

I'm all for this law exactly the way it is. Just don't think criminal liability should be absolved because the lines are already blurred and that would allow someone to intentionally run someone over that may not even actually be in the street. Absolving civil liability is a must though.
