If yes, you have a chance. If you are a white male, you are screwed. There is that white privilege again....

Do you work for a large corp as in nationwide? If so - this helps your cause. Most large corps will not follow the right to work laws of individual states

What was the original letter of concern? Does it relate to your sub-par review? This could be bad.

It appears that they have 2 months of documentation on you. Again - if you are a white male it is not looking good.

As far as changing job descriptions - that is irrelevant and can be done. Especially if you were given in writing updated job requirements.

Good luck. The corporate world truly sucks. The goal is to work hard, make yourself valuable and get promoted.

But the higher you get, the closer you are to the axe.

I've done quite a few retaliation, HWE/harassment cases in my time. We did not do contingency cases. Some will, but it just depends on state/law/forum/etc.

You need to talk to an employment attorney. Was your HWE grievance based on on anything specific?

Maybe you were just a shitty employee or at least a trouble maker , not trying to be a dick but good help is hard to find ...

Maybe it's time for some self reflection , be honest with yourself , did you really put forth good effort or is it that in reality after 9 years you had become content on just skating by with a subpar work ethic and a bad attitude.....

The good news is you can move forward with a new venture and correct your shortcomings but only if you're honest with yourself ...... Good luck
